The parties agree that scheduling provisions may be waived for the period of December 15 to January 15. It is understood that employees will work either Christmas or New Year’s on an alternating yearly basis. In the event employees may be granted both Christmas and New Year’s off this will be granted at the employee’s request and will be approved in accordance with bargaining unit seniority. (12i) hours A nurse may, by mutual agreement of completing a scheduled tour or premium payment the nurse and the Employer, work either permanent evenings, permanent nights, days and evenings, days and nights, evenings and nights. Any such request shall be paidmade to the immediate supervisor or designate, who shall approve or deny the request in writing as soon as possible but no less than twenty-one (21) calendar days of receipt of the request. If approved, the nurse will be transitioned into the permanent shift arrangement at the start of the next posted schedule. Such request will not be unreasonably denied. The nurse may request written reasons should the request be denied. Either the Employee or the Employer may discontinue the permanent shift arrangement. The parties, with the union representative, will be notified in writing of the reasons for the discontinuation. The nurse will receive sixty (60) days’ notice that the permanent shift arrangement will be discontinued. (j) The Employer shall ensure that nurses not be required to work more than two (2) shift rotations, that is, any two (2) but not three (3) of days, evenings and nights. Where a nurse does not usually work the day shift, the Employer may require the nurse to rotate to the day tour for a maximum of two work weeks per annum for the purpose of providing training and development or for scheduling a group function. In scheduling this period, six (6) weeks’ notice shall be provided to the nurse. If the Employer is required to change the mix of shift rotations on a unit, it shall be done a seniority basis. (k) A nurse who normally rotates shall not be scheduled to work more than two

An employee will receive premium pay of time and one-half (1 ½) for all hours worked on the third and additional, if any, consecutive and subsequent weekend, save and except where: i) such weekend has been worked by the employee to satisfy specific days off requested by such employee; or ii) such employee has requested weekend work; or iii) such weekend is worked as the result of an exchange of shifts with another employee. (f) Employees presently employed on specific tours with specific days off on a permanent basis, will not be rotated without their consent. The Employer will consider requests from employees hereinafter employed, for permanent evening or night tours and such requests will be granted when possible. (g) At least two (2) full tours of time shall be scheduled between shifts or changeover of shifts. A shorter period of time shall be scheduled between shifts or changeover of shifts by mutual consent. (h) Should the Employer be required to change the schedule of shifts or days off with less than sixteen (16) hours' notice, the employee(s) involved in such change(s) will be paid time and one-half (1-1/2) their regular straight hourly rate for their first shift in this new schedule. Effective July 17, 2007 applies to full-time employees only. Should the Employer be required to change the schedule of shifts or days off, the employee(s) involved in such change(s) will be notified of such change(s). (i) Any employee who arrives up to two (2) hours from the completion of the Friday tour until after the commencement of a tour because of being called with short notice shall be compensated for the Monday full tour. iv(j) An employee who is called in or reports for work as scheduled shall receive a minimum of four (4) hours' pay. (k) The Employer undertakes scheduling regulations will not operate during the period of December 15th to use its best effort consistent with proper management January 15th. (l) A weekend off shall be defined as fifty-six (56) consecutive hours commencing no later than 2300 hours on Friday. The following applies to part-time employees only: (a) If an employee works a fourth consecutive and subsequent weekend, she/he will receive premium payment of the Hospital time and one-half (1 ½) for all hours worked on that weekend and subsequent weekends until a weekend is scheduled off, save and except where: i) such weekend has been worked by an employee to ensure that satisfy specific days off may be taken consecutively and days off rotated so requested by such employee; ii) such employee has requested weekend work; or iii) such weekend was worked as to effect a result of an equal distribution among the full-time nursesexchange with another employee. v) The Employer will endeavour as far as reasonably possible to provide some day tours when available. vi) A nurse shall not be required to commence work within twelve (12) hours of completing a scheduled tour or premium payment shall be paid.

Scheduling Regulations. F-1 Tour schedules shall (a) Requests for days off need to be posted, except in cases of emergency, submitted two (2) weeks prior to the schedule being posted. Schedules shall be posted six (6) weeks in advance and shall cover at least a six (6) week period or full-time period. Where the Hospital intends to post a schedule for other than the normal posting period, nurses will shall be paid premium pay on the first tour notified in advance of the new scheduleduration of the posting period. No nurse shall be responsible for acknowledging any change in the posted schedule unless notified by the Supervisor in charge of the department at least forty-eight (48) hours before the date of the change. The schedule covering the prime vacation months of July and August shall be posted on or before April 30 and the schedule covering the Christmas and New Year’s seasons shall be posted on or before November 1. (b) Requests for specific days off are to be submitted, submitted in writing, writing at least two (2) weeks in advance of the posting of the schedule and such requests may be granted at the discretion of the Hospital. Requests for specific days off which are submitted less than two (2) weeks prior to the posting of schedules, or which occur following the posting of schedules, must be processed in accordance with Article H-6 (c). The Hospital shall endeavour to distribute shifts in an equitable fashion at the time of schedule posting. Where an employee has declared unavailability prior to the posting of the schedule, such declaration will result in twenty-two and one-half (22.5) hours less for each seven (7) days requested off in a six (6) week period, excluding days off for unpaid education purposes. These hours will be deemed to count towards the hospital’s obligation to distribute the shifts equitably. F-2 Request for Tour Changes F-3 Where there is (c) Nurses shall give the Hospital, in writing, notice of intent to exchange shift(s), together with a change signed undertaking from the nurse willing to exchange such shift(s). This notice of intent and a signed undertaking will be provided to the Hospital using the prescribed electronic method as identified by the Hospital, which shall be accepted as written notice. In exceptional circumstances, telephone consent may be requested from the Hospital, it being understood that the nurses involved in the schedule from one day proposed exchange must still confirm the request in writing. Such requests shall be subject to the approval of the Hospital, shall not result in any premium payments and shall not be unreasonably denied. Where partial shift exchanges are approved, total hours paid will not exceed the original scheduled hours. (d) A nurse will be scheduled off work for not less than five (5) consecutive days at either the Christmas or New Year’s season unless the nurse requests otherwise, except in areas which are not normally required to another day shift commencing at different start times work on weekends and paid holidays. Scheduling Regulations. F-1 Tour schedules shall (a) Requests for days off need to be posted, except in cases of emergency, submitted two (2) weeks prior to the schedule being posted. Schedules shall be posted six (6) weeks in advance and shall cover at least a six (6) week period or full-time period. Where the Hospital intends to post a schedule for other than the normal posting period, nurses will shall be paid premium pay on the first tour notified in advance of the new scheduleduration of the posting period. No nurse shall be responsible for acknowledging any change in the posted schedule unless notified by the Supervisor in charge of the department at least forty-eight (48) hours before the date of the change. The schedule covering the prime vacation months of July and August shall be posted on or before April 30 and the schedule covering the Christmas and New Year’s seasons shall be posted on or before November 1. F-2 Request for Tour Changes F-3 Where there is (c) Nurses shall give the Hospital, in writing, notice of intent to exchange shift(s), together with a change signed undertaking from the nurse willing to exchange such shift(s). In exceptional circumstances, telephone consent may be requested from the Hospital, it being understood that the nurses involved in the schedule from one day proposed exchange must still confirm the request in writing. Such requests shall be subject to the approval of the Hospital, shall not result in any premium payments and shall not be unreasonably denied. Where partial shift exchanges are approved, total hours paid will not exceed the original scheduled hours. (d) A nurse will be scheduled off work for not less than five (5) consecutive days at either the Christmas or New Year’s season unless the nurse requests otherwise, except in areas which are not normally required to another day shift commencing at different start times work on weekends and paid holidays. (j) The Employer shall endeavour to ensure that nurses not be required to work more than two shift rotations, that is, any two but not three of days, evenings and nights. Where a nurse does not usually work the day shift, the Employer may require the nurse to rotate to the day tour for a maximum of two work weeks per annum for the purpose of providing training and development or for scheduling a group function. If the Employer is required to change the mix of shift rotations on a unit, it shall be done a seniority basis. (k) A nurse who normally rotates shall not be scheduled to work more than two (2) consecutive weeks on evening or night shift without the nurse’s written consent or request, and shall not be scheduled to work more than two consecutive weeks on either evening shift or night shift without being scheduled for an equal period on day shift. Scheduled time off shall not be considered part of any shift. (l) The Employer shall endeavour to schedule a Nurse off on a paid holiday falling on a Monday or Friday if the paid holiday is adjacent to a scheduled tour or premium payment weekend off. The Hospital may discontinue the permanent shift arrangement with sixty (60) days notice to the nurse. The Hospital reserves the right to require the nurse normally working a permanent shift to work other shifts for reasons which include refamiliarization and in-service. D.2 Requests for change in posted time schedules must be submitted prior to the exchange, in writing and co-signed by the nurse willing to exchange days or tour of duty initiated by the nurse and approved by the Hospital. These exchanged tours will be deemed as worked when scheduling up to a Part Time Nurse's committed hours of work, as set out in Article D.6 (part-time only). D.3 A full-time nurse will be scheduled off work for not less than five (5) consecutive days at either Christmas or New Year's (unless the nurse requests otherwise) and except in areas which are not normally required to work on weekends and paid holidays. Scheduling Regulations. F-1 Tour schedules shall (a) Requests for days off need to be posted, except in cases of emergency, submitted two (2) weeks prior to the schedule being posted. Schedules shall be posted six (6) weeks in advance and shall cover at least a six (6) week period or full-time period. Where the Hospital intends to post a schedule for other than the normal posting period, nurses will shall be paid premium pay on the first tour notified in advance of the new scheduleduration of the posting period. No nurse shall be responsible for acknowledging any change in the posted schedule unless notified by the Supervisor in charge of the department at least forty-eight (48) hours before the date of the change. The schedule covering the prime vacation months of July and August shall be posted on or before April 30 and the schedule covering the Christmas and New Year’s seasons shall be posted on or before November 1. (b) Requests for specific days off are to be submitted, submitted in writing, writing at least two (2) weeks in advance of the posting of the schedule and such requests may be granted at the discretion of the Hospital. Requests for specific days off which are submitted less than two (2) weeks prior to the posting of schedules, or which occur following the posting of schedules, must be processed in accordance with Article H-6 (c). The Hospital shall endeavour to distribute shifts in an equitable fashion at the time of schedule posting. Where an employee has declared unavailability prior to the posting of the schedule, such declaration will result in twenty-two and one-half (22.5) hours less for each seven (7) days requested off in a six (6) week period, excluding days off for unpaid education purposes. These hours will be deemed to count towards the hospital’s obligation to distribute the shifts equitably. F-2 Request for Tour Changes F-3 Where there is (c) Nurses shall give the Hospital, in writing, notice of intent to exchange shift(s), together with a change signed undertaking from the nurse willing to exchange such shift(s). This notice of intent and a signed undertaking will be provided to the Hospital using the prescribed electronic method as identified by the Hospital, which shall be accepted as written notice. In exceptional circumstances, telephone consent may be requested from the Hospital, it being understood that the nurses involved in the schedule proposed exchange must still confirm the request in writing. Such requests shall be subject to the approval of the Hospital and the hospital will endeavour to respond within three (3) business days from one day the date of submission to the Hospital. Priority will be given to processing and responding to exchange requests that are for upcoming shifts within seven (7) days. It is understood that such changes shall not result in any premium payments and shall not be unreasonably denied. Where partial shift exchanges are approved, total hours paid will not exceed the original scheduled hours. (d) A nurse will be scheduled off work for not less than five (5) consecutive days at either the Christmas or New Year’s season unless the nurse requests otherwise, except in areas which are not normally required to another day shift commencing at different start times work on weekends and paid holidays. F-3 Where there is a change in the schedule from one day shift to another day shift commencing at different start times on the same day, the change (e) Nurses will not normally be considered scheduled to work more than five (5) consecutive days, unless otherwise mutually agreed upon. (f) No less than forty-eight (48) hours shall be scheduled off on a tour change in schedule as defined under Article 14.12from the night tour, unless otherwise mutually agreed. (g) Unless otherwise mutually agreed, there will be an equal distribution of standby duty with the option to change within areas where standby is required. If the nurse is advised need arises during the term of this agreement for a significant increase in standby occurrences, the parties will meet to discuss a Letter of Understanding. (h) The Hospital will endeavour to provide an equitable distribution of shift work assigned to nurses in any unit of the change and unable to accept it due to extenuating circumstances and the Employer unilaterally changes the start time, premium pay would be applicable if the change is made with insufficient notice as per Article 14.12Hospital (full-time only). F-4 (i) A full-time nurse may request not, without her consent, be required to change tours of duty more than once during a work week (full-time only). The Hospital will endeavour to schedule a full-time nurse to work days and one other shift, that is, days and evenings or days and nights. In order to facilitate the creation of new full-time positions, the Hospital may introduce permanent shifts (i.e. night, evening or day shifts only) and staff such positions in accordance with Article 10.07 of the Collective Agreement. Consideration will be given by the Hospital to a nurse who requests to work evening or nights on a permanent evening or night shiftbasis. Where If such request is made accepted by the following Hospital, the schedule will be dealt with according to Article D.5 (full-time only). The Hospital may discontinue the permanent shift arrangement with sixty (60) days notice to the nurse. The Hospital reserves the right to require the nurse normally working a permanent shift to work other shifts for reasons which include refamiliarization and in-service. D.2 Requests for change in posted time schedules must be submitted prior to the exchange, in writing and co-signed by the nurse willing to exchange days or tour of duty initiated by the nurse and approved by the Hospital. No premium payment will result from the requested exchange. These exchanged tours will be deemed as worked when scheduling up to a Part Time Nurse's committed hours of work, as set out in Article D.6 (part-time only). D.3 A full-time nurse will be scheduled off work for not less than five (5) consecutive days at either Christmas or New Year's (unless the nurse requests otherwise) and except in areas which are not normally required to work on weekends and paid holidays. The Hospital shall endeavour to give time off over either Christmas or New Year's, on an alternating basis, so that nurses will not be required to work the same holiday from year to year, unless by request of the nurse or by mutual consent. The normal scheduling conditions shall applybe waived to accommodate this special arrangement between December 15th and January 10th. Time off at Christmas shall include December 24th, 25th and 26th, and time off at New Year's shall include December 31st, January 1st and January 2nd night tour. Schedules showing such days off shall be posted by November 15th. If approved, the nurse will be transitioned into the permanent shift arrangement at the start of the next posted schedule. Such request will not be unreasonably denied. The nurse may request written reasons should the request be denied. Either the Employee or the Employer may discontinue the permanent shift arrangement. The parties, with the union representative, will be notified in writing of the reasons for the discontinuation. The nurse will receive sixty (60) days’ notice that the permanent shift arrangement will be discontinued. (j) The Employer shall ensure that nurses not be required to work more than two (2) shift rotations, that is, any two (2) but not three (3) of days, evenings and nights. Where a nurse does not usually work the day shift, the Employer may require the nurse to rotate to the day tour for a maximum of two work weeks per annum for the purpose of providing training and development or for scheduling a group function. In scheduling this period, six (6) weeks’ notice shall be provided to the nurse. If the Employer is required to change the mix of shift rotations on a unit, it shall be done a seniority basis. (k) A nurse who normally rotates shall not be scheduled to work more than two (2) consecutive weeks on evening or night shift without the nurse’s written consent or request, and shall not be scheduled to work more than two consecutive weeks on either evening shift or night shift without being scheduled for an equal period on day shift. Scheduled time off shall not be considered part of any shift. (l) The Employer shall endeavour to schedule a Nurse off on a paid holiday falling on a Monday or Friday if the paid holiday is adjacent to a scheduled tour or premium payment weekend off. Nurses scheduled on the weekend adjacent to a paid holiday shall be paidscheduled to work the paid holiday, unless mutually agreed otherwise. (m) Applies to Occupational Health Nurses only: Occupational Health Nurses shall not be scheduled to work more than six (6) consecutive calendar days in a row. Note: Unless otherwise stated, all provisions of the Collective Agreement shall apply to occupational health nurses. (n) The above regulations may be waived provided that the nurse and the Employer mutually agree in writing to the change. An electronic copy of the agreement will be forwarded to the Union.

Scheduling Regulations. F-1 Tour schedules D – 1 (a) The Hospital will continue the current practice of scheduling every other weekend off. A nurse will receive premium payment in accordance with Article 14.03 for all hours worked on a third consecutive and subsequent weekend save and except where: (i) Such weekend has been worked by the nurse to satisfy specific days off requested by such nurse; or (ii) Such nurse has requested weekend work; or (iii) Such weekend is worked as a result of an exchange of shifts with another nurse. (b) A weekend consists of fifty-six (56) consecutive hours off work during the period following the completion of the Friday day shift until the commencement of the Monday day shift. D - 2 Scheduling Regulations (a) A period of at least two (2) tours will be scheduled between shifts worked by a nurse unless a lesser period of time is mutually agreed upon between the nurse and her/his immediate supervisor. (b) A request by a nurse for a change of scheduled working hours must be submitted in writing, co-signed by the nurse willing to exchange tours, prior to the shift affected. Such change initiated by the nurse will not result in additional cost to the Hospital. All changes must be approved by the Nurse Manager or designate. Such request shall not be unreasonably denied. (c) No split tours. (d) Schedules shall be posted, except in cases of emergency, posted two (2) weeks in advance and shall cover at least a six (6) week period or full-time nurses period. Requests will be paid premium pay on the first tour of the new schedule. Requests for specific days off are to be submitted, in writing, at least two submitted four (24) weeks in advance of postingthe posting of the schedule. F-2 Request for Tour Changes F-3 Where there is a change in the schedule from one day shift to another day shift commencing at different start times on the same day, the change will not be considered a change in schedule as defined under Article 14.12. If the nurse is advised of the change and unable to accept it due to extenuating circumstances and the Employer unilaterally changes the start time, premium pay would be applicable if the change is made with insufficient notice as per Article 14.12. F-4 A full-time nurse may request to work a permanent evening or night shift. Where such request is made the following conditions shall apply: i(e) The nurse will submit a written request to the Manager with a copy to the Union. ii) The Manager will provide a written response to the nurse stating her ability to honour such a request, with the provision that either the nurse or the Manager may discontinue the scheduling arrangement with four (4) weeks written notice in advance of the posted schedule. A copy of such response shall be forwarded to the Union. iii) The permanent shift arrangement applies to the individual nurse, not to the position and therefore when a nurse vacates such arrangements, said vacant line will revert back to a regular rotating line consistent with the remainder of the master rotation. iv) A nurse on permanent evening or night shift will twice a year spend two (2) weeks on day shift at a mutually agreeable time. These intervals will be at least three (3) to four (4) months apart. F-5 Scheduling - 7.5 hours (a) Full-time i) Master rotations including an individual nurses position within a master, will not be changed without first informing the nurse and the bargaining unit president and or designate. ii) A nurse Nurses will not be scheduled to work more than seven (7) consecutive days without receiving days, unless requested by the nurse. (f) The Hospital will endeavour to schedule at least one half (½) of a nurse's tours on the day shift. (g) At least forty-eight (48) hours time off shall be scheduled following a block of tours on the night shift. A "block of tours" is defined as two (2) or more. (h) Not more than two (2) consecutive days off or premium payment shall be paid. iii) The Employer will schedule full-time every second weekend off or premium pay will apply. The Employer will endeavour to schedule a nurse for a day shift prior to the nurse’s weekend off. The Employer agrees that a weekend weeks will be defined as sixty (60) hours from the completion of the Friday tour until the commencement of the Monday tour. iv) The Employer undertakes to use its best effort consistent with proper management of the Hospital to ensure that days off may be taken consecutively and days off rotated so as to effect an equal distribution among the full-time nurses. v) The Employer will endeavour as far as reasonably possible to provide some day tours when available. vi) scheduled on evenings or nights unless otherwise mutually agreed. A nurse shall will not be required to commence change shifts more than once during a work within twelve week. (12i) hours These regulations may be waived between December 20th and January 5th so that nurses will receive five (5) or more consecutive days off at either Christmas or New Year's in alternating years. Christmas time off will include December 24th, December 25th and December 26th and New Year's time off will include December 31st and January 1st. The Hospital will give six (6) weeks' notice to nurses of completing a Christmas and New Year's time off. This provision shall not apply to any unit in which nurses normally work Monday to Friday and are not normally scheduled tour to work on paid holidays. (j) FULL-TIME ONLY (k) The Hospital will consider requests for permanent evening or premium payment night tours. Application shall be paidsubmitted to the manager and the Union will be informed of all such agreements.

Scheduling Regulations. (h) The Hospital will endeavour to provide an equitable distribution of shift work assigned to nurses in schedule as defined under Article 14.12. If the nurse is advised any unit of the change and unable to accept it due to extenuating circumstances and the Employer unilaterally changes the start time, premium pay would be applicable if the change is made with insufficient notice as per Article 14.12Hospital (full-time only). F-4 (i) A full-time nurse may not, without her consent, be required to change tours of duty more than once during a work week (full-time only). The Hospital will endeavour to schedule a full-time nurse to work days and one other shift, that is, days and evenings or days and nights. In order to facilitate the creation of new full-time positions, the Hospital may introduce permanent shifts (i.e. night, evening or day shifts only) and staff such positions in accordance with Article 10.07 of the Collective Agreement. Consideration will be given by the Hospital to a nurse who requests to work evening or nights on a permanent basis. If such request is accepted by the Hospital, the schedule will be dealt with according to Article D.5 (full-time only). The Hospital may discontinue the permanent shift arrangement with sixty (60) days notice to the nurse. The Hospital reserves the right to require the nurse normally working a permanent shift to work other shifts for reasons which include refamiliarization and in-service. (k) An employee scheduled to work a permanent evening tour of less than 7.5 hours in the operating room will be offered any additional available hours following the end of that scheduled shift, which additional available hours the nurse may work at her option. D.2 Requests for change in posted time schedules must be submitted prior to the exchange, in writing and co-signed by the nurse willing to exchange days or tour of duty initiated by the nurse and approved by the Hospital. These exchanged tours will be deemed as worked when scheduling up to a Part Time Nurse's committed hours of work, as set out in Article D.6 (part-time only). D.3 A full-time nurse will be scheduled off work for not less than five (5) consecutive days at either Christmas or New Year's (unless the nurse requests otherwise) and except in areas which are not normally required to work on weekends and paid holidays. The Hospital shall endeavour to give time off over either Christmas or New Year's, on an alternating basis, so that nurses will not be required to work the same holiday from year to year, unless by request of the nurse or by mutual consent. The normal scheduling conditions shall be waived to accommodate this special arrangement between December 15th and January 10th. Time off at Christmas shall include December 24th, 25th and 26th, and time off at New Year's shall include December 31st, January 1st and January 2nd night shifttour.
