Common use of Scope of Grievances Clause in Contracts

Scope of Grievances. ‌ A. A grievance may be filed if a management interpretation or application of the provisions of this Memorandum of Understanding adversely affects an employee's wages, hours or conditions of employment. B. Specifically excluded from the scope of grievances are: 1. subjects involving the amendment or change of State law, Rules and/or orders of the Superior Court, or Board of Supervisors resolutions, ordinances or minute orders, which do not incorporate the provisions of this Memorandum of Understanding; 2. matters which have other means of appeal; 3. position classification; 4. standard or better performance evaluations.; 5. failure of new probation where discrimination is not alleged.
