SEARCH AND SURVEY. At its own expense, Seller shall furnish and deliver to the attorney for Buyer no later than thirty (30) days after the Effective Date, a correct, up-to-date county or title company's history (abstract) of title, made from the records in the County Clerk's Office, commencing with a warranty or better deed which conveys a l00% fee interest, recorded no later than January 1, 1945, fully guaranteed tax, title and United States District Court searches dated subsequent to the Effective Date (the “Searches”) together with a copy of any existing instrument surveys of the Property in Seller’s possession. Buyer shall be permitted to obtain an updated instrument survey of the Property, meeting the standards of the Onondaga County Bar Association, prepared by a surveyor licensed in the State of New York, certified to Buyer and such other parties as Buyer may designate, showing the Property together with all improvements thereon, if any, and all easements, rights-of-way and encroachments affecting the Property and certifying the exact acreage of the Property measured from the boundary line of any adjoining rights of way (the “Updated Survey”). Seller will cooperate in the preparation of the Updated Survey, if required.

SEARCH AND SURVEY. The Seller shall order within ten (10) days after the date of this Agreement fully guaranteed tax, title and United States District Court searches, and searches under the Uniform Commercial Code of records in the appropriate offices as against the Sellers, dated or redated subsequent hereto, and a copy of the most recent title policies and instrument survey(s) of the Property. Prior to Closing, the Seller shall deliver to Buyer an update of the instrument survey(s) previously delivered, dated or redated subsequent hereto certified to such persons and organizations as may be designated by Buyer, made by a land surveyor duly licensed by the State of New York, showing the boundaries of the land conveyed hereunder, all improvements thereon and the location of all easements, all improvements thereon and the location of all easements, rights-of-way or similar encroachments affecting same, prepared and certified in accordance with the code of practice adopted by the New York State Association of Professional Land Surveyors. Notwithstanding the foregoing, the redated survey(s) must not differ in any material respects from the survey initially delivered to and reviewed by Buyer. The Seller shall pay for the continuation of said tax, title, United States District Court, local tax and Uniform Commercial Code searches to and including the date of Closing and for any required revenue stamps in connection with the transfer.
SEARCH AND SURVEY. Within ten (10) days after the mutual execution and delivery of this Contract, Seller shall (i) deliver to Purchaser a copy of any existing survey in Seller’s possession of the Premises, (ii) order an updated survey of the Premises with a new metes and bounds description of the Premises, and (iii) order a forty year abstract of the Premises.
SEARCH AND SURVEY. At its own expense, Grantee shall obtain, at least twenty (20) days prior to the end of the Investigation Period, fully guaranteed tax, title and United States District Court searches dated subsequent to the Effective Date (the “Searches”) and Grantee shall provide at its own expense any survey of the Premises (the “Survey”) desired by Grantee. In addition, during the Investigation Period, Grantee , at its own expense, shall obtain a title insurance commitment for any title insurance policy desired by Grantee issued by a nationally recognized title insurance company (the “Title Commitment”).
SEARCH AND SURVEY. Seller has furnished to Buyer a copy of the most recent survey and title insurance policy relating to the Project.

  • Survey Buyer may obtain a survey of the Property before the Closing to assure that there are no defects, encroachments, overlaps, boundary line or acreage disputes, or other such matters, that would be disclosed by a survey ("Survey Problems"). The cost of the survey shall be paid by the Buyer. Not later than business days prior to the Closing, Buyer shall notify Seller of any Survey Problems which shall be deemed to be a defect in the title to the Property. Seller shall be required to remedy such defects within business days and prior to the Closing. If Seller does not or cannot remedy any such defect(s), Buyer shall have the option of canceling this Agreement, in which case the Xxxxxxx Money shall be returned to Buyer.
