Section 9.7. Leave of Absence. 8 An employee may request a leave of absence or leave without pay for personal or professional reasons 9 by written request to the employee’s immediate supervisor. 11 Upon recommendation of the immediate supervisor, through administrative channels to the 12 superintendent, and upon approval of the Board of Directors, an employee may be granted an extended 13 leave of absence without pay, for up to one (1) year. The returning employee will be assigned to the 14 position occupied before the leave of absence. If the position is no longer available, due to budget, 15 student or staffing needs the returning employee will be assigned to a like position in which they are 16 qualified for with equal number of hours, and shall suffer no loss of wages or benefits. Employees 17 hired to fill positions of employees on leave of absence will be hired for a specific period of time, 18 during which they shall be subject to all provisions of this Agreement. It shall be the responsibility of 19 the District to inform replacement employees of these provisions. 21 An employee on leave of absence must confirm his/her intent to return to the District for the next 22 succeeding year. The District will send the employee a certified letter forty-five (45) calendar days 23 before the date of approved leave expires, reminding the employee of his/her rights and responsibilities 24 to this section of the CBA and request them to inform the District in writing forty-five (45) days prior 25 to the date he/she intends to return to work. The employee will have fourteen (14) days of receipt of 26 the letter to inform the District the date he/she intends to return to work. If the employee fails to notify 27 the District of his/her intent to return to work, the District will consider the position vacated by the
