9.07 A seniority annually publish a list of all Employees covered employees by this agreement field of current major teaching assignment listed in seniority order. This list shall be published and posted in January and June each school by February 15 of each year. The Employees who wish to appeal their placement on this list must do so in writing to the Human Resources Office before March 1 of the year the list is published. A final list shall be published by March 31 each year. An employee's failure to question prior to March 1 his/her seniority date and classification on the first published list will show names, positions preclude the assertion of incorrect seniority date and classification in challenging a subsequent layoff. Ifan employee's seniority date or classification is different on the second list as compared to the first list such employee has three (3) days from the posting of hire for each Employee (or hours in the case second list to appeal the change. The Association will be made aware of part-time Employees). Copies the composition of the seniority list will be posted on all bulletin boards and one copy will be mailed prior to the Unionposting of such list. 20:02 Displacements, transfers, demotions and one copy promotions to positions covered by this agreement, shall be based on ability, qualifications, performance, and seniority. Ability, qualifications, and performance being sufficient, seniority shall prevail. Company management shall be the sole judge of ability, qualifications and performance.
20:03 A seniority list for permanent employees will be mailed compiled annually and updated as required. Employees will be added to the Union. The seniority list when they become permanent, on completion of 6 months continuous employment in a position covered by this agreement excluding any training periods. Seniority calculation will be based on an employee's date of hire with the Company.
20:04 Employees with less than 6 months sea service with the Company will be considered correct on probation and shall have no rights under the seniority rules of the agreement.
20:05 When reducing staff, employees with the most seniority will be retained. When increasing staff, laid-off employees will be recalled to fill vacancies for all purposes unless which they are qualified in order of seniority.
20:06 Employees shall lose their seniority with the Employee disputes its accuracy within Company when:
(a) they are discharged for cause;
(b) they fail to return to work following a recall (notice period longer than 48 hours) from layoff;
(c) they fail to return to work following an approved leave of absence or sick leave without just cause;
(d) they resign;
(e) they are promoted to a position outside the bargaining unit for a period in excess of twelve months.
20:07 Employees shall retain and accumulate their seniority with the Company when absent due to:

SENIORITY, LAYOFF AND RECALL. 9.01 A. By September 30 of each year the District shall prepare a seniority list for bargaining unit employees, and for administrators entitled to seniority pursuant to the Transfers Article. B. Copies of the seniority list will for all teachers and/or employees in the District shall be posted on all bulletin boards in the respective buildings by October 15 of each school year. Revisions of the seniority list shall be posted as made. A copy of the seniority list, and one copy will subsequent revisions, shall be mailed provided to the UnionAssociation. Within five (5) school days of such posting, each teacher and/or employee shall either sign the seniority list next to his/her name, the place provided, or shall file a written, signed objection to the revision with the Superintendent. The seniority list will be considered correct Association may also object to such revisions, in writing, within five (5) school days of such posting. If no written objections have been made within such period or, if written objection has been made, upon final resolution of the validity of such objection, the District may conclusively rely upon the accuracy of such lists for all purposes unless of this Agreement and for purposes of future revisions of such lists. 9.07 A seniority list of all Employees covered employees by classification in seniority order. For purposes of this agreement article there shall be four (4) classifications: Baker, Cook, Lead Worker, and General Worker. This list will be posted in January and June each building by March 15 of each year. The Employees who wish to appeal their placement on this list must do so in writing to the Personnel Office by April 30 each year. An employee's failure to question prior to April 30, his/her placement on the first posted list, will show namespreclude the assertion of incorrect placement in challenging any subsequent actions having to do with seniority. Once an appeal has been adjudicated, positions no further appeal for the same reason will be honored. A copy of the draft and date of hire for each Employee (or hours in the case of part-time Employees). Copies final version of the seniority list roster will be posted on all bulletin boards and one copy will be mailed provided to the Union. The seniority list will be considered correct for all purposes unless Association President.
7:2.1 In the Employee disputes its accuracy within event two (2) calendar weeks from or more employees in the date same classification have the list was postedsame seniority date, a lottery will be used to break the tie. A probationary Employee Seniority shall not have recourse to begin on the Grievance or Arbitration Procedure if he or she is laid off or is discharged during first full day of work and shall be credited as such upon successful completion of the probationary period. In the circumstances of date of hire of more than one individual beginning employment on the same date, a drawing will be conducted to determine position on the seniority list. Should there be any employees holding the same seniority date within the same classification upon ratification of this Agreement, a drawing will be conducted as outlined above within ten (10) days following ratification to determine seniority for those employees.
D. The Board shall post a seniority list no later than October 1st of each year. This list shall be arranged in order of departmental seniority and shall show each employee’s department seniority and District seniority. Said list shall be posted in a conspicuous location at each place of employment. The local Association President shall receive a copy of each seniority list published. The seniority list shall contain the name, last date hired in the district, last date hired in the department and seniority ranking within each department.
E. An employee shall lose his/her seniority rights if he/she retires, resigns, is discharged for just cause, fails to notify the district of their intent to return to work within ten (10) working days following receipt of a written recall to employment while on layoff, or is laid off for a period of more than two (2) years. It is expressly understood that seniority is not lost during an unpaid leave of absence or a period of layoff, nor shall it accumulate during that time. Employees currently in special cases and by mutual agreement between the Township and bargaining unit shall not have their seniority dates adjusted due to this above language for actions prior to the Unionratification of this Agreement.
