Separation and divorce. The Spouse of the Annuitant who is a former member or a member ceases to be entitled to the pension benefit provided for in Paragraph 18.b) hereof upon separation from bed and board, divorce, nullity of marriage, nullity or dissolution of a civil union or, in the case of a Spouse who is not married or civil union Spouse, upon cessation of conjugal relationship, unless the Annuitant has transmitted to the Trustee the notice provided for in section 89 of the Act.

Separation and divorce. In the event of a separation or divorce, the Parties agree that all Separate Property shall subsist and continue as the sole property of the relevant party. Each Party hereby waives, releases and relinquishes any and all rights whatsoever, whether arising by common or statutory law (present or future) to the other Party’s Separate Property. In the event of separation or divorce, all property acquired after marriage which is jointly owned shall be subject to division, either by agreement or judicial determination.
