---SERVICE AVAILABLE TO ALL RESIDENTS. (a) Subject to paragraph (c) below and Section 4.2, the area to be served is the entire Town of Amherst. Service shall be provided to every dwelling occupied by a Person requesting Cable Service that can be reached by the Cable System via the public right of way in the Town or easements in the Town over which the Town has control, provided that the Licensee is able, in addition, to obtain from owners of private property any necessary easements and/or permits in accordance with applicable law(s).
(b) The Licensee shall make its Cable System available to residents of the Town, unless legally prevented from doing so, subject only to the installation charges herein.
(c) Installation charges shall be non-discriminatory. A standard aerial installation charge shall be established by the Licensee which shall apply to any residence located not more than one hundred seventy-five feet (175’) from the existing aerial Trunk and Distribution System and additions thereto. The Licensee may charge residents located more than 175’ from the existing aerial Trunk and Distribution System, and additions thereto, time and materials charges. The Licensee shall have up to, but not more then, ninety (90) days in order to survey, design and install non-standard installations that are more than 175’ from the existing aerial Trunk and Distribution System and additions thereto, subject to Force Majeure, including the performance of utility make ready work, if any.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The Licensee shall make its Cable System Service available to all residents of the Town, subject only to the installation charges herein.
(b) Installation charges shall be non-discriminatory. A standard aerial installation charge shall be established by the Licensee which shall apply to any residence located not more than one hundred fifty feet (150') from the existing aerial Trunk and Distribution System and additions thereto.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) Subject to subsection (b) and (c) below, The Licensee shall make its service available to every residential (non-commercial) dwelling unit in the service area in the Town, regardless of the type of dwelling, or its geographical location unless legally prevented from doing so.
(b) Any dwelling unit within two hundred fifty feet (250') of the existing Cable System plant shall be entitled to a standard aerial installation rate. Any aerial installation over 250 feet from the existing cable plant requiring Trunk or Distribution type construction shall be considered non-standard and provided at a rate based upon actual costs and a reasonable return on investment. The Licensee may reasonably charge subscribers for non-standard or customized installations.
(c) Underground installation shall be considered standard and therefore subject to standard underground installation rates within 250 feet of the existing cable plant, provided no Trunk or Distribution type construction is required and sub-surface is dirt or similar soft surface. Underground installations within 250 feet of the existing cable plant requiring Trunk or Distribution type construction or involving a hard surface or that require boring through rock or under sidewalks, street, flower bedding, etc., are considered non-standard installations and shall be provided at a rate based upon actual costs and a reasonable return on investment. Installations more than 250 feet from existing cable plant requiring Trunk or Distribution type construction or involving a hard (concrete, asphalt, etc.) surface shall be provided at a rate based upon actual costs and a reasonable return on investment.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The Licensee shall make its Cable Service available to all residents in the Town, subject to Section 5.2(b) and Section 5.3 below.
(b) Installation charges shall be non-discriminatory. Any dwelling unit within two hundred (200) feet of the Licensee's nearest feeder cable(s) shall be entitled to a standard installation rate. Any installation in excess of 200’ shall be provided upon payment of the Licensee's customary charge, for those portions in excess of 200'.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The area to be served is substantially the entire Town of Xxxxxxx Service shall be provided to every dwelling occupied by a Person requesting Cable Service that can be reached by the Cable System via the public right of way in the Town or easements in the Town over which the Town has control, provided that the Licensee is able, in addition, to obtain from owners of private property any necessary easements and/or permits in accordance with applicable law(s).
(b) The Licensee shall make its Cable System available to substantially all residents of the Town, unless legally prevented from doing so, subject only to the installation charges herein.
(c) The Licensee’s obligation to extend its Cable System to Streets of the Town not already served by the Licensee as of the Effective Date of this Renewal License shall be limited to those Streets in which the Licensee’s cost of construction is no greater than Five Hundred Dollars ($500.00) per dwelling unit, unless prospective Subscribers within said Streets agree to pay all additional costs in excess of said $500.00 amount.
(d) Installation charges shall be non-discriminatory. A standard aerial installation charge shall be established by the Licensee which shall apply to any residence located not more than one hundred twenty-five feet (125') from the existing aerial Trunk and Distribution System and additions thereto. The Licensee may charge residents located more than 125’ from the existing aerial Trunk and Distribution System, and additions thereto, time and materials charges. The Licensee shall have up to, but not more than, ninety (90) days in order to survey, design and install non-standard installations that are more than 125’ from the existing aerial Trunk and Distribution System and additions thereto.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) Subject to subsection (b) and (c) below, the Licensee shall make its Service available to every residential (non-commercial) dwelling unit in the service area along the Subscriber Network Trunk and Distribution route as it exists as of the Renewal License Execution Date in the Town, regardless of the type of dwelling, or its geographical location unless legally prevented from doing so.
(b) Any dwelling unit within two hundred fifty feet (250') of the existing Cable System plant shall be entitled to a standard aerial installation rate. Any aerial installation over 250 feet from the existing cable plant requiring Trunk or Distribution type construction shall be considered non-standard and provided at a rate based upon actual costs and a reasonable return on investment. The Licensee may reasonably charge subscribers for non-standard or customized installations.
(c) Underground installation shall be considered standard and therefore subject to standard underground installation rates within 250 feet of the existing cable plant, provided no Trunk or Distribution type construction is required and sub-surface is dirt or similar soft surface. (a) Subject to subsection (c) below, t The Licensee shall make its service available to every residential (non-commercial) dwelling unit in the service area in the City, except units located within a commercial properties, regardless of the type of dwelling, or its geographical location unless legally prevented from doing so.
(b) Installation charges shall be non-discriminatory, except that an additional charge for time and materials may be made for customized installation within a Subscriber's residence or except when the Licensee is engaged in marketing promotions.
(c) Any dwelling unit within two hundred fifty feet (250') of the existing Cable System plant shall be entitled to a standard aerial installation rate. Licensee may reasonably charge subscribers for non- standard or customized installations. Any aerial installation over 250 feet from the existing cable plant requiring trunk or distribution type construction shall be considered non-standard and provided at a rate based upon actual costs and a reasonable return on investment. Underground installation shall be considered standard and therefore subject to standard underground installation rates within 250 feet of the existing cable plant, provided no trunk or distribution type construction is required and sub surface is dirt or similar soft surface. Underground installations within 250 feet of the existing cable plant requiring trunk or distribution type construction or involving a hard surface or that require boring through rock or under sidewalks, street, flower bedding, etc., are considered non-standard installations and shall be provided at a rate based upon actual costs and a reasonable return on investment. Installations more than 250 feet from existing cable plant requiring trunk or distribution type construction or involving a hard (concrete, asphalt, etc.) surface shall be provided at a rate based upon actual costs and a reasonable return on investment.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The Licensee shall make its Cable Service available to all residents of the City, regardless of the type of dwelling or its geographical location in the City, subject to Section 4.1(b) below, unless the Licensee is legally prevented from providing such Service.
(b) Installation charges shall be non-discriminatory, except that an additional charge for time and materials may be made for customized installation within a Subscriber's residence or except when the Licensee is engaged in marketing promotions. Any dwelling unit within four hundred feet (400') of the Cable System plant shall be entitled to a standard aerial installation rate. Any aerial installation greater than 400' shall be provided at the Licensee's actual cost, including the cost for system design changes to extend the cable plant to within 400' of the dwelling unit. Any underground installation shall be provided at the Licensee's actual cost.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The Licensee shall make its Cable Service available to all residents of the Town, subject to 4.1(b) below, unless the Licensee is legally prevented from doing so by factors outside of the Licensee’s control, including, but not limited to, denial of access by owners of private property or multiple dwelling units.
(b) Installation charges shall be non-discriminatory. A standard aerial installation charge shall be established by the Licensee which shall apply to any residence located not more than one hundred fifty feet (150') from the existing aerial Trunk and Distribution System and additions thereto. The Licensee may charge residents located more than 150’ from the existing aerial Trunk and Distribution System and additions thereto, time and materials charges will apply for that portion beyond 150’.
---SERVICE AVAILABLE TO ALL RESIDENTS. (a) The Licensee shall make its Cable System Service available to all areas subject to the Licensee being able to obtain any necessary easements and/or permits, subject paragraph (b) below.
(b) Following the completion of the original Cable System, the Licensee shall provide Cable Service to residents in new homes or developments, as a standard installation, within ninety (90) days of a request therefore, subject to (i) the Licensee being able to obtain any necessary easements and/or permits; and (ii) there being twenty (20) homes per aerial mile and/or twenty (20) homes per underground mile, provided that there is existing underground conduit that is made available to the Licensee, measured from the nearest Trunk and Distribution System, or thirty (30) homes per underground mile, assuming that there is no available conduit for use by the Licensee, measured from the nearest Trunk and Distribution System. The Licensee shall expeditiously apply for any necessary easements and/or permits.
(c) Installation charges shall be non-discriminatory. A standard aerial installation charge shall be established by the Licensee, which shall apply to any residence located not more than two hundred feet (200') from the existing aerial and underground Trunk and Distribution System and additions thereto.
