Service Usage and Data Storage. Any Fees for designated levels of usage and data storage (each a “Service Allocation”) will be set forth in the applicable CribMaster Order Form, beginning with the Fees payable by Distributor for the levels of usage and data storage in effect as of the Effective Date. CribMaster will notify Distributor in writing if Distributor has reached eighty (80) percent of its then current Service Allocation and Distributor may increase its Service Allocation and corresponding Fee obligations in accordance with this Agreement and Schedule A. If Distributor exceeds its Service Allocation for any relevant period, Distributor shall also pay to CribMaster the applicable excess usage and storage Fees set forth in the applicable CribMaster Order Form. Distributor acknowledges that exceeding its then-current Service Allocation may result in service degradation for Distributor and other CribMaster customers and agrees that (i) CribMaster has no obligation to permit Distributor to exceed its then-current Service Allocation and (ii) no denial of service by CribMaster as a result of Distributor voluntarily or involuntarily exceeding its then-current Service Allocation shall be deemed to be an event of Service Unavailability.

  • DELIVERY, STORAGE, AND HANDLING The Contractor shall be responsible to inspect all components on delivery to ensure that no damage occurred during shipping or handling for furnish and installation projects. For equipment only purchases, the ordering entity shall be responsible to inspect all components on delivery. Materials must be stored in original undamaged packaging in such a manner to ensure proper ventilation and drainage, and to protect against damage, weather, vandalism, and theft until ready for installation.

  • Service Use Restrictions In connection with your use of the Services, you sha l not in any way transmit, publish, post, upload, disseminate, or distribute any (i) corrupted files, viruses, trojan horses, worms, spyware, time bombs, cancelbots, or any other similar software or programs; and/or ( i) defamatory, infringing, vulgar, sexua ly explicit, obscene, indecent, o fensive, inappropriate, profane, or unlawful content or any hate speech (i.e., racist/discriminatory speech). You sha l also not (i) impair anyone else from using the Services or interfere with the proper functioning of the Services; ( i) access the Services (including by use of robots, scripts, spiders or other automated means) other than via the means provided by us; ( i) misrepresent your identity in any way; (iv) overburden the Services in any way; and/or (v) violate any law, rule or regulation in connection with your use of or access to the Services.

  • The Web Services E-Verify Employer Agent agrees to, consistent with applicable laws, regulations, and policies, commit sufficient personnel and resources to meet the requirements of this MOU.

The facility consists of a two-bay truck rack with 17,000 barrels of active terminaling capacity, 13 above-ground storage tanks with approximately 1.1 million barrels of total storage capacity. The Hartford barge dock consists of a single-berth barge loading facility, approximately 0.8 miles of 8-inch pipeline and approximately 0.8 miles of 14-inch pipeline from the Hartford terminal to the Hartford barge dock for delivery.
