Services Excluded. Services provided by EFM do NOT include immunizations, medical devices, urgent or emergency medical services, hospital care, radiology, or other specialty healthcare needs. Referrals may be made for these services when necessary.

b. On-site support; c. Support of the Application beyond the Subscription;
Services Excluded. No services for implementation, installation, development and/or training are included with a license purchase.

The services according to table 1 are not available on the following holidays: ▪ Easter Thursday from 4 p.m. till the first Tuesday after Easter at 6 a.m./ (CEST) ▪ Christmas 24th Dec. from 4 p.m. till 27th Dec. at 6 a.m./ (CET) ▪ New-Year 31st Dec. from 4 p.m. till 2nd Jan. 6 a.m./ (CET)
Services Excluded. Membership in the PRACTICE does not include immunizations, laboratory tests, medical devices, emergency room medical services, specialist care, Patient Agreement 2 hospital care, radiology, or other specialty health care needs. Patients may refer to the service price lists for details. If the Provider feels a health care need is outside of the scope of his/her training, referral to a specialist will be warranted. Membership in the PRACTICE does not preclude medically necessary specialist evaluation or referral as deemed appropriate by the Provider. Although the PRACTICE may help procure specialist cash pricing for the Members and Non- members, the PRACTICE does not guarantee discounted specialist pricing. If the PRACTICE does not have information providing specialist cash pricing on hand, it will be the patient’s responsibility to obtain such pricing at the specialist's office to whom the provider refers the Member.

Services Excluded. The parties may specifically exclude certain services from the operation : of this Agreement by written addendum hereto and acknowledge and agree that the following items are not intended to be included among the services to be provided by WCC:
2.8.1 WCC agrees that neither it or any affiliate or fund with which it is associated is or shall be a market-maker, dealer or underwriter of any of the Company's securities (but may be a placement agent from time to time) in the Company's securities;
2.8.2 Any payments made herein to WCC are not, and shall not be construed as, compensation to WCC for the purposes of making a market, to cover WCC out-of-pocket expenses for making a market, or for the submission by WCC of an application to make a market in any of the Company's securities;
2.8.3 No payment made herein to WCC are for the purpose of affecting the price of any security or influencing any market-making functions, including but not limited to bid/ask quotations; initiation and termination of quotations, retail securities activities, or for the submission of any application to make a market.
2.8.4 It is understood and agreed that in performing any of the services contemplated by this Agreement, WCC shall not be taken to be rendering any legal opinions or any work that is in the ordinary purview of a Certified Public Accountant or of a licensed NASD broker/dealer.

Services Excluded. (i) The Service Provider will retain control over all proceedings and when in the Service Provider's view proceedings should not be commenced or should be settled, the Service Provider shall cease to act if the Service Purchaser disagrees with that advice
(ii) The Service Purchaser will be responsible for all disbursements to include court fees, counsel fees, agent's fees, witnessfees/expenses, search fees, land registry fees and other payments concerned with the acquisition and disposal of land, costs awarded against the Service Purchaser, or such other payments as are necessary in the conduct of the matter. The Service Provider will consult the Service Purchaser before incurring any expenditure and will advise the Service Purchaser of the likely cost of any proceedings
(iii) Notwithstanding any other provision of the Agreement, the Head of Legal, Democratic and Procurement Service’s statutory responsibility is to act as monitoring officer and as solicitor to the Council. Should statutory duties conflict with instructions received from the Service Purchaser, or should any conflict of interest arise between the Service Purchaser and the Service Provider, the Service Provider shall cease to act and the Service Purchaser shall be free to gain advice or representation from other sources
(iv) In addition to the Service provided in Section 5 of this Agreement, the Provider can, on terms to be agreed with the School, supply a full range of legal services (for example), representation for the School in legal proceedings and attendance at formal hearings conducted by the Governing Bodies) and also training to suit the needs of the school
