Services for CM at Risk Projects. Designer’s performance of the following services related specifically to the CM at Risk delivery method shall be compensated as noted herein: A. Designer’s Services Regarding CM Prequalification and Selection Committees. Pursuant to M.G.L. c. 149A, §§ 5 and 6, the Designer is required to participate on a statutorily established prequalification and selection committees for the evaluation and selection of the CM firm. All services performed by Designer in accordance with the prequalification and selection committee requirements of M.G.L. c. 149A, including but not limited to: Designer’s review and evaluation of the qualifications and proposal submissions from interested CM firms, participation in committee meetings, deliberations and evaluations. Option 1: Such services shall be compensated as SERVICES. Option 2, if CM responses are obtained during schematic design: Such services have been authorized and paid for during the Project’s Study Phase. Any such ongoing services during the Design Phase shall be treated as BASIC SERVICES. B. Designer’s Services Regarding Trade Contractor Prequalification. Pursuant to M.G.L. c. 149A, § 8, the Designer is required to participate on a statutorily established trade contractor prequalification committee. All services performed by Designer in accordance with the prequalification committee requirements of M.G.L.

  • Critical Infrastructure Subcontracts For purposes of this Paragraph, the designated countries are China, Iran, North Korea, Russia, and any countries lawfully designated by the Governor as a threat to critical infrastructure. Pursuant to Section 113.002 of the Business and Commerce Code, Contractor shall not enter into a subcontract that will provide direct or remote access to or control of critical infrastructure, as defined by Section 113.001 of the Texas Business and Commerce Code, in this state, other than access specifically allowed for product warranty and support purposes to any subcontractor unless (i) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is majority owned or controlled by citizens or governmental entities of a designated country; and (ii) neither the subcontractor nor its parent company, nor any affiliate of the subcontractor or its parent company, is headquartered in a designated country. Contractor will notify the System Agency before entering into any subcontract that will provide direct or remote access to or control of critical infrastructure, as defined by Section 113.001 of the Texas Business & Commerce Code, in this state.

Supplier will have a defined process to address any findings but will ensure that any high-risk vulnerabilities are addressed within 30 days.

  • Operations Support Systems Functions 9.1 Effective as of February 8, 2021, notwithstanding any other term or condition of the Amended Agreement or a Verizon tariff or SGAT, and subject to the transitional provisions set forth in Subsection 9.2 below, unbundled access to Operations Support Systems Functions will not be available from Verizon on or after February 8, 2021, except when such functions are used to manage other UNEs that remain available from Verizon, local interconnection, or local number portability. 9.2 Any unbundled access to Operations Support System Functions eliminated pursuant to Section 9.1 above will continue to be provisioned for the period in which unbundled access is available to the UNE managed through the use of such functions, but not after such period.
