Serving as a Witness. Preparing to serve or serving as a witness in connection with any public hearing (except for a contractor’s hearing necessitated by its request to substitute a subcontractor), dispute resolution proceeding or legal proceeding, other than that necessitated by the negligent acts, errors or omissions of Construction Manager or where the Construction Manager is party thereto.
Serving as a Witness. A City Wastewater Division Chemist subpoenaed as a witness shall collect all fees and allowances payable as a result of the service and forward the fees to the City Finance Office. Witness fees shall be applied against the amount due the employee from their employer. However, if an employee elects to charge their witness fees off against their a1111ual leave, they shall not be required to remit their witness fees to their employer. In no instance is an employee required to remit to their employer any expense or mileage allowances paid him/her by the Court.
Serving as a Witness. The hourly rates which include direct costs, indirect costs, overhead, administrative costs, and profit, to be utilized in arriving at a negotiated fee for Extra Services, are set forth in Exhibit E. Payment for Extra Services will be either on a time and materials basis or a firm fixed price, as determined by the Judicial Council. If the Project is delayed more than 180 days, based on the original schedule listed in Exhibit D, Judicial Council will adjust the Construction Manager’s hourly rates using the US Department of Labor CPI index for urban wage earners and clerical workers, US city average. Any escalation costs shall be capped at a ten percent (10%) increase from the original cost.
Serving as a Witness. For services performed by Engineer’s employees as witnesses giving testimony in any litigation, arbitration, or other legal or administrative proceeding under paragraph A2.01.A.20, at the rate of $ 200.00 per day or any portion thereof (but compensation for time spent in preparing to testify in any such litigation, arbitration, or proceeding will be on the basis provided in paragraph C4.03.A.1). Compensation for Engineer’s Consultants for such services will be on the basis provided in paragraph C4.06.
Serving as a Witness. A. For services performed by Engineer's employees as witnesses giving testimony in any litigation, arbitration or other legal or administrative proceeding under Paragraph A2.01.A.20, at a rate of 1.0 times the witness’s standard hourly rate. Compensation for Consultants for such services will be by reimbursement of Consultants' reasonable charges to Engineer for such services.
Serving as a Witness. 3.5.1 The Engineer shall provide testimony in public hearings, arbitration proceedings, and legal proceedings, and such testimony shall be provided without additional fee or charge to the Owner unless said testimony is requested by the Owner and consists of expert testimony not related to this Project or Work.
Serving as a Witness. For services performed by Engineer’s employees as witnesses giving testimony in any litigation, arbitration, or other legal or administrative proceeding under paragraph A2.01.A.20, at the rate of $ 200.00 per day or any portion thereof (but compensation for time spent in preparing to testify in any such litigation, arbitration, or proceeding will be on the basis provided in paragraph C4.03.A.1). Compensation for Engineer’s Consultants for such services will be on the basis provided in paragraph C4.06. apply. The amounts that might be charged as Reimbursable Expenses are included in compensation for Basic Services, so there is no separate charge for Reimbursable Expenses incurred while performing Basic Services.
Serving as a Witness. For the services for the principals and employees as architects or witnesses in any litigation, hearing or proceeding, on the basis of payroll costs times a factor of 2.4.
Serving as a Witness. Pursuant to Montana State law, a City Parks and Recreation Department employee subpoenaed as a witness shall collect all fees and allowances payable as a result of the service and forward the fees to the accounting office. Witness fees shall be applied against the amount due the employee from his/her employer. However, if an employee elects to charge his/her witness fees off against his/her annual leave, he/she shall not be required to remit his/her witness fees to his/her employer. In no instance is an employee required to remit to his/her employer any expense or mileage allowances paid him/her by the Court.
Serving as a Witness. For the services rendered by principals and employees as consultants or witnesses in any litigation, hearing or proceeding in accordance with Paragraph 2.1.11 at the rate of no more than $175 per hour or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be on the basis provided in Paragraph 4.1.1).
