Any fee or compensation for the service itself must be returned to the County for any days of absence for which the employee receives hourly rate of pay/salary as for a day worked, except that if such service occurred during the employee's vacation or other authorized leave of absence, then the employee may retain the fee or compensation paid for such service.

No deductions shall be made from the pay of an employee for an absence from work when subpoenaed to appear in court as a witness, except when the individual is a litigant either (a) in a matter not arising out of the individual's course and scope of employment; (b) in a matter arising out of the course or scope of employment that is initiated by the employee; or (c) in a matter arising out of the course and scope of employment not initiated by the employee where the employee has been found to be liable for punitive damages or has been found guilty of criminal conduct.
