SERVING AS WITNESS. 3.5.1 The Design Consultant shall provide testimony in public hearings, arbitration proceedings, and legal proceedings, and such testimony shall be provided without additional fee or charge to the Owner unless said testimony is requested by the Owner and consists of expert testimony not related to this Project or Work.

No deductions shall be made from the hourly rate of pay/salary of a regular employee for an absence from work when subpoenaed to appear in court as a witness, other than as a litigant. Mileage and other actual expense reimbursement received as a result of service as a witness may be retained by the employee. Any fee or compensation for the service itself must be returned to the County for any days of absence for which the employee receives hourly rate of pay/salary as for a day worked, except that if such service occurred during the employee's vacation or other authorized leave of absence, then the employee may retain the fee or compensation paid for such service.
SERVING AS WITNESS. If a licensed employee is subpoenaed to appear as a witness in a civil or criminal case in which the employee is not a party in interest, the employee shall have the amount of payment from the court as a witness deducted from his/her salary.

No deductions shall be made from the pay of an employee for an absence from work when subpoenaed to appear in court as a witness, except when the individual is a litigant either (a) in a matter not arising out of the individual's course and scope of employment; (b) in a matter arising out of the course or scope of employment that is initiated by the employee; or (c) in a matter arising out of the course and scope of employment not initiated by the employee where the employee has been found to be liable for punitive damages or has been found guilty of criminal conduct. Mileage and other actual expense reimbursement received as a result of service as a witness may be retained by the employee. Any fee or compensation for the service itself must be returned to the County for any days of absence for which the employee receives salary as for a day worked, except that if such service occurred during the employee's annual leave or other authorized leave of absence, then the employee may retain the fee or compensation paid for such service.
SERVING AS WITNESS. 3.5.1 The Design Consultant, and any required Sub-Consultant, shall prepare for and provide testimony or otherwise participate in public hearings, and legal proceedings, including as necessary to secure governmental approval of zoning or land use clearances, for the Project as part of Basic Services, unless said testimony or participation is requested by the Owner and consists of expert testimony not related to this Project or the Construction Manager’s work.
