Service as a Witness. A. Each employee who is under a proper summons as a juror shall collect all fees and allowances payable as a result of the service and forward the fees to the appropriate accounting office. Juror fees shall be applied against the amount due the employee from his Employer. However, if an employee elects to charge his juror time off against his annual leave, he shall not be required to remit his juror fees to his Employer. In no instance is an employee required to remit his Employer any expense or mileage allowance paid him by the court.

Service as a Witness. 30 When an employee is absent from work in order to serve as a witness in a case in a court of law to which such 31 employee is not a plaintiff or defendant either directly or as a member of a class action and where such absence is 32 in response to a legally valid subpoena, such employee shall be granted pay for those hours for which the employee 33 is absent from work, consistent with the provisions of Subsection A of this Section. Such employee may be 34 required to submit evidence of such service as a witness to the Company in order to qualify for such payment. 35

Service as a Witness. Unless agreed to otherwise by LOUDOUN WATER, for services performed by ENGINEER's principals and employees as consultants or witnesses in any litigation, arbitration, or other legal or administrative proceeding, ENGINEER shall be compensated on a Direct Labor Costs Times a Factor basis for the time spent to prepare for, and appear in, any such litigation, arbitration, or proceeding. Compensation for ENGINEER's Consultants for such services will be on the basis provided in Paragraph 7.03.
