Sick Leave Donation Program. This program has been established to help those operators who are in need because their own serious health condition or the serious health condition of their immediate family member as defined under the Family Medical Leave Act, and who have exhausted all other paid leave including sick leave, personal leave, and vacation time, and compensatory time. This program does not supersede or replace any other retirement or disability program. When the Personnel Office is made aware of the need for sick leave donations, a notice will be sent to all eligible participating operators requesting their help. Any eligible operator may then voluntarily elect to contribute, permanently, sick leave credits for a Sick Leave Catastrophic Incident. For donations the following criteria will apply: A. Only regular, full-time, non-probationary, eligible operators are able to donate sick leave credits or to be a recipient of a donation. A sick leave credit donation is permanent and therefore cannot be returned to the donor or converted to cash by the donee’s estate. E. The sick leave credits will be used in place of the operator's regularly scheduled workdays to the extent they are necessary. F. A donated sick leave credit will not count as a separate absence for the donating operator. G. Donated sick leave credits can be used to cover retroactive unpaid regularly scheduled workdays. H. An operator will not accrue vacation or sick leave while receiving donated sick leave. I. An operator may receive up to 480 hours of donated sick leave during a rolling twelve month period measured backward until donations are not available. J. An operator's illness or disability must be certified by a physician. K. Part time employees will contribute prorated hours to match FTE equivalent to the sick leave bank. The Director of Human Resources and the Association President will determine whether donated leave for the individual will be granted. If donated leave is granted, the Director of Human Resources will notify the member in writing of the number of days granted and will inform the payroll department to deduct the credit grant hours from the operator's sick leave balancebank to the member. The leave is limited in scope to Klamath County School District licensed employees who voluntarily donate sick leave hours using the form provided. New employees become eligible to participate in the sick leave bank within thirty (30) calendar days of the initial hire date within a given year. New employees wishing to contribute to the bank must do so within their first thirty (30) days of employment. Current employees who have not participated previously shall be permitted to enroll not later than October 31 of any year with an effective eligibility date of November 1 of that year. Any unused donated leave will be maintained returned to the sick leave bank at the end of the school year. Donated hours or days used for any illness other than the serious health condition listed on the employee’s physician statement would be considered misuse of donated leave. Unused donated hours will remain in the donor's personnel filesick leave bank and will not be returned to donors. In July, the Director of Human Resources will provide the Association with documentation of sick leave bank usage for the previous school year. At that time, both the District and the Association will determine the cap for the bank. The payroll clerk cap will credit not exceed eight (8) hours per licensed FTE in the donee's donated District. The intent of this bank is to help those in need, and so to facilitate this, both the Association and the District will work together to resolve any sick leave balance bank issue not covered by the number of credits received from other operatorsthis Article. L. If an operator returns to work before using all of the donated sick leave, the operator may request the balance be added to their regular sick leave line total.

Sick Leave Donation Program. This program has been established to help those operators employees who are in need because their own serious health condition or the serious health condition of their immediate family member as defined under the Family Medical Leave Act, and who have exhausted all other paid leave including sick leave, personal leave, and vacation time, and compensatory time. This program does not supersede or replace any other retirement or disability programprograms. When the Personnel Human Resources Office is made aware of the need for sick leave donations, a notice will be sent to all eligible participating operators employees requesting their help. Any eligible operator employee may then voluntarily elect to contribute, permanently, sick leave credits for a Sick Leave Catastrophic Incident. For donations In addition the following criteria will apply: A. Only regular, full-time, non-probationary, eligible operators employees are able to donate sick leave credits or to be a recipient of a donation. The operator employee must have at least forty (40) sick leave credits three hundred and twenty (320320 hours) hours accumulated at the time of donation. B. A sick leave credit will be defined as eight (8) hours and will not have an hourly rate attached. C. An operator employee may contribute only five (5) sick leave credits forty (4040 hours) hours per year. D. A sick leave credit donation is permanent and therefore cannot be returned to the donor or converted to cash by the donee’s 's estate. E. The sick leave credits will be used in place of the operatoremployee's regularly scheduled workdays to the extent they are necessary. F. A donated sick leave credit will not count as a separate absence for the donating operatoremployee. G. Donated sick leave credits can be used to cover retroactive unpaid regularly scheduled workdays. H. An operator employee will not accrue vacation or sick leave while receiving donated sick leave. I. An operator employee may receive up to 480 hours of donated sick leave during a rolling twelve month period measured backward until donations are not available. J. An operatoremployee's illness or disability must be certified by a physician. K. X. When an operator employee is about to exhaust their own accumulated sick leave, a request for donated sick leave may be made in writing to the Human Resources Director. The physician's certification must be attached to the request. The City will determine eligibility for donations and that determination will be final. If it is determined that an operator employee is eligible to receive donated sick leave credits, eligible employees will be notified in writing of the request for donations. An operator employee who voluntarily chooses to donate sick leave credits must complete a Sick Leave Donation Form and submit it to the supervisor who will notify the payroll department to deduct the credit from the operatoremployee's sick leave balance. A copy of the donation form will be maintained in the donor's personnel file. The payroll clerk will credit the donee's donated sick leave balance by the number of credits received from other operatorsemployees. L.
