Common use of Sick Leave During Leave of Absence and Lay Off Clause in Contracts

Sick Leave During Leave of Absence and Lay Off. When an employee is given a leave of absence without pay for any reason for more than one (1) week, or is laid off on account of lack of work and returns to the service of the Employer upon expiration of such leave of absence, she shall not receive credit for the period of such absence, except as may be otherwise approved and authorized by the Employer, but shall retain her cumulative sick leave credit, if any, existing at the time of such leave.

When an employee is given a paid leave of absence without pay for any reason he/she shall receive sick leave credit for more than one (1) week, or the period of such absence on his/her return to work and shall be entitled to use such sick leave credits upon their return. When an employee is laid off on account of lack of work and returns to the service of the Employer upon expiration of such leave of absence, he/she shall not receive credit sick leave credits for the period of such absence, except as may be otherwise approved and authorized by the Employer, absence but shall retain his/her cumulative sick leave credit, if any, existing at the time of such leavelay-off.
