Software Distribution a. You are entitled to distribute Software to Customers and HPE Authorized Partners, as authorized by this Addendum, for resale or internal use, respectively. b. Pass Through Process. You shall provide your Customers or other HPE Authorized Partners with the relevant Supporting Materials, such as but not limited to (i) product-specific Additional Licensing Authorizations (ALAs), (ii) Support data sheets, (iii) SaaS Service Descriptions, (iv) HPE Data Protection Regulations, (v) XXXX etc. Supporting Materials are contained within the Product packaging, with HPE quotes, on indicated web pages or the HPE Partner Portal, or available upon request. Supporting Materials contain HPE´s obligations towards the Customer with regard to any transaction with you under this Agreement. You may provide more extensive representations and commitments to Customers, as long as we have no responsibility for fulfilling such additional obligations. HPE is not responsible for your acts or omissions, for any obligations undertaken by you or representations that you may make, or for any other products or services that you supply to other HPE Authorized Partners and/or Customers.

Software Distribution. If You provide or distribute any software at the Event, the use terms and/or the end user license agreement provided or distributed with such software will govern the use of the software, and in the event of any conflict with the terms of this Agreement, such use terms and/or other license agreement will control.
Software Distribution. The Software in a form suitable for electronic reproduction and distribution. Before delivering any computer program to Publisher, Software Owner must first test the computer program to ensure it is, to a reasonable extent, free of defects. Bug Fixes. Bug fixes or software patches as are reasonably required to ensure proper operation of the Software in accordance with its accompanying documentation.

Software Distribution. 4.1 If the individual software license is a desktop operating system (including Windows XP Media Center Edi- tion), we grant you a nonexclusive right to distribute individual software licenses; provided that each one is dis- tributed with either (a) a fully assembled computer system or (b) a nonperipheral computer hardware component. A “fully assembled computer system” means a computer system consisting of at least a central pro- cessing unit, a motherboard, a hard drive, a power supply, and a case. A “nonperipheral computer hardware component” means a component that will be an integral part of the fully assembled computer system on which the individual software license will be installed. 4.2 If the individual software license is application or server software, we grant you a nonexclusive right to dis- tribute individual software licenses; provided that each one is distributed with a fully assembled computer system. 4.3 Each individual software license must be distributed pursuant to the end-user license agreement (“XXXX”) that accompanies the individual software license. Under the terms of the XXXX, you are the licensor.
Software Distribution. 4.1 MANUFACTURER grants to RESELLER a nonexclusive right to preinstall and distribute one (1) copy of the SOFTWARE solely on a fully assembled computer system authorized by MANUFACTURER for such preinstallation and distribution. For the purposes of this License, a fully assembled computer system consists of at least a central processing unit, a motherboard, a hard drive, a power supply, and a case. 4.2 The SOFTWARE may only be distributed pursuant to the End User License Agreement (“XXXX”) that accompanies the SOFTWARE. Under the terms of the XXXX, the MANUFACTURER is the licensor. 4.3 After preinstallation of the SOFTWARE, the remainder of the PACKAGE, except for this License, must be distributed to an end user together with the MANUFACTURER’s computer system that contains the preinstalled SOFTWARE.

If the enclosed Software Unit includes a Microsoft desktop operating system program, MS grants to you a non-exclusive right to distribute each Software Unit, provided it is distributed accompanied with either a fully assembled computer system or non-peripheral computer hardware component. A fully assembled computer system shall consist of at least a central processing unit, a motherboard, a hard drive, a power supply and a case. 4.2. If the enclosed Software Unit includes a Microsoft application or server program, MS grants to you a non-exclusive right to distribute each Software Unit, provided it is distributed to the end user accompanied only with a fully assembled computer system. 4.3. Each Software Unit may only be distributed to an end user pursuant to the end user license agreement that accompanies the Software Unit.
