The parties agree to work together to address the issue of confidentiality of the Licensed Technology which is provided over the Internet.

Given the open nature and public accessibility of these systems, BofA's obligations with respect to confidentiality of the Licensed Technology are to take commercially reasonable precautions to protect the confidentiality of the Licensed Technology distributed through these systems. The Parties agree to work together to address the issue of confidentiality of the Licensed Technology which is provided over the Internet.

Notwithstanding anything to the contrary herein, the certificates, statements, reports and other information to be furnished pursuant to this Section 12.1 may be furnished in electronic form complying with technological requirements reasonably acceptable to the recipient thereof.

An enterprise is able to choose the layers they need to employ.
