Spare Professional Capacity. Where you intend to undertake Private Professional Services or Fee Paying Services other than such work carried out under the terms of this Contract, whether for the NHS, for the independent sector or for another party, the provisions in Schedule 7 and Schedule 10 of the TCS will apply.

Spare Professional Capacity. The parties have agreed changes to the provisions relating to spare professional capacity stating that if a doctor intends to undertake remunerated clinical work as a locum, the doctor is strongly encouraged to initially offer such additional hours of work to the service of the NHS via an NHS staff bank of their choosing.
Spare Professional Capacity. 8.1. The 2016 TCS, Section 5, outlines contractual limits on working hours and rest periods. While in this employment, you should not ordinarily undertake work outside of this contract. Where you do wish to undertake any such work as a locum, you must first offer your services to the Trust as set out in the paragraphs pertaining to locum work in Section 5 of the TCS.

  • INDEPENDENT CAPACITY The employees or agents of each party who are engaged in the performance of this Agreement shall continue to be employees or agents of that party and shall not be considered for any purpose to be employees or agents of the other party.
