Common use of Standby Clause in Contracts

Standby. (a) A standby duty roster and schedule may be established at locations when, in the opinion of NAV CANADA, it is warranted by operating conditions. (b) An employee designated for standby duty shall be available during his or her period of standby duty at a known telephone number and be able to report for duty as quickly as possible if called. (c) An employee on standby duty shall be compensated at the rate of one-half (1/2) hour for each four (4) hour period or portion thereof for which he or she has been designated as being on standby duty. No compensation shall be granted for the total period of standby duty if the employee is unable to report for duty when required. (d) An employee on standby who is called in to work and who returns to the workplace shall be entitled to the greater of: (i) compensation equivalent to three (3) hours’ pay at the applicable rate for overtime; except that this minimum shall only apply once during a single period of eight (8) hours. (ii) compensation at the applicable rate for his or her overtime worked. and shall receive credit under this clause for the full four (4) hour period of standby duty in which he or she is called out. (e) An employee receiving calls from his or her manager or a person delegated by his or her manager concerning urgent operational matters requiring them to work will be compensated by one and one-half (1 ½) hours’ pay at the straight time rate. Where a call or the work exceeds one hour, he or she shall be entitled to the compensation applicable under clause 33.06(a). (f) Travel time spent by the employee called back to work or returning to his or her residence shall not constitute time worked. (g) NAV CANADA agrees that in areas and in circumstances where electronic paging devices are both practicable and efficient, they will be provided without cost to those employees on standby duty. (a) When an employee, after having completed his or her normal daily hours of work, has left his or her place of work and prior to reporting for his or her next regular scheduled work period, is called back to work and returns to the workplace for a period of non-contiguous overtime he or she shall be entitled to the greater of: (i) compensation equivalent to three (3) hours’ pay at the applicable rate for overtime (ii) compensation at the applicable rate for overtime worked. (b) Travel time spent by the employee called back to work or returning to his or her residence shall not constitute time worked. Standby. (a) A regular employee designated by the Employer to be on standby, at a time or times other than her/his regular working hours, shall be paid the following premiums: (i) Twenty (20) hours pay at Chargehand rate of pay for each week in which the employee was on standby; and (ii) Eight (8) hours pay at Chargehand II rate of pay for each statutory holiday in which the employee was on standby. (b) An employee designated for standby duty In the Parks and Public Works Divisions there will be eight (8) regular full-time employees who shall be available during his or her period placed on a roster that is rotated on a weekly basis. These employees shall be appointed by the Employer through a posting based upon its operational needs, seniority considered, from among the group of employees who, in the Employer's opinion, possess the necessary qualifications, experience, skill and ability, relative to the requirements of the job, to perform the work which might arise while on standby. Those employees so appointed after posting shall be rotated on a regular basis so that the standby duty at work is distributed among them in a known telephone number and be able to report for duty as quickly as possible if calledfashion deemed equitable by the Employer. (c) An Any employee on standby duty required by the Employer to carry and to respond to communication devices such as, but not limited to, cell phones, electronic mail via computers, pagers or mobile radios outside their regular work schedule shall be compensated at the rate of one-half paid as per (1/2a) hour for each four (4) hour period or portion thereof for which he or she has been designated as being on standby duty. No compensation shall be granted for the total period of standby duty if the employee is unable to report for duty when requiredabove. (d) An A regular employee in the Information Technology Division designated by the Employer to be on standby who is called in to work and who returns to the workplace standby, at a time or times other than her/his regular working hours, shall be entitled to paid the greater offollowing premiums: (i) compensation equivalent to three Six (36) hours’ hours pay at Pay Grade 20 for each weekend in which the applicable rate for overtime; except that employee was on standby. For the purposes of this minimum clause, the weekend shall only apply once during a single period of eight (8) hoursbe from 4:30 p.m., Friday through the weekend until 8:00 a.m. the following Monday. (v) These employees shall be appointed by the Employer based upon its operational needs, from among the group of employees who, in the Employer’s opinion, possess the necessary qualifications, experience, skill and ability, relative to the requirements of the job, to perform the work which might arise while on standby. Those employees so appointed shall be rotated on a regular basis. (vi) An employee receiving calls from his or her manager or a person delegated by his or her manager concerning urgent operational matters requiring them to work will be compensated by one and one-half (1 ½) hours’ pay at the straight time rate. Standby.
