Missed Meal Breaks. (a) (applicable to full-time employees only) If an employee is authorized to work, during the lunch break, due to the requirements of patient care, he will be paid time and one-half (1½) his regular straight time hourly rate for all time worked in excess of his normal daily hours. (b) (applicable to part-time employees only) If an employee is authorized to work, during the lunch break, due to the requirements of patient care, he will be paid his regular straight time hourly rate for all hours worked. Notwithstanding this provision, he will be paid time and one-half (1½) his regular straight time hourly rate for all time worked in excess of the normal or standard work day.

If required to work the employee will be paid time and one-half (1 ½) their regular straight time hourly rate. The unpaid portion of an 11.25-hour shift is 45 minutes total and in a 7.5 hour shift is 30 minutes total. (d) Employees required to carry a pager and not allowed to leave the Hospital premises during unpaid meal breaks shall be compensated at the overtime rate of time and one-half (1½).

Missed Meal Breaks. (a) When a paramedic crew does not receive an entitled meal break prior to the respective periods, the paramedic crew shall notify the DC and complete a missed meal break form. They will be compensated one and a half (1.5) times their rate of pay for an additional thirty (30) minutes to their scheduled shift, in respect of each meal break which was missed during the shift. This shall be considered missed meal break compensation. For clarity, it is agreed that where missed meal break compensation is payable, late meal break compensation shall not be payable in respect of the same meal break. (b) In order to be entitled to missed meal break compensation, a paramedic crew must have notified the DC, as described in paragraph (8) and (9), that they did not receive a meal break prior to the sixth (6th) hour of a shift or prior to the eleventh (11th) hour of a shift, as the case may be, except where other work-related obligations prevented such notification. (c) When a paramedic crew does not receive a meal break prior to the sixth (6th) hour of a scheduled eight (8) hour or greater shift, the paramedic crew shall notify the DC. It is the paramedic crew’s responsibility to immediately notify the DC when they have worked six (6) consecutive hours and have not had a meal break. Upon advisement by the paramedic crew, the DC will advise CACC that the crew should be assigned to the closest geographical EWEMS station and designated “Out of Service”. The Out of Service designation will not be assigned while EWEMS is in the level yellow, red or black status; and shall not be otherwise unreasonably denied.
