v. Noncompliance with the requirements of nondiscrimination in services shall constitute grounds for state to withhold payments under this Agreement or terminate all, or any type, of funding provided hereunder.

These provisions are hereby deemed incorporated in this Agreement at this place. To the extent of any conflict between any other provision of this Agreement and Appendix V, Appendix V shall control. The Operator shall comply with such terms and conditions during the Term.
State Law Requirements. To the extent that state law applicable to Business Associate pursuant to Section 27.5 of the Current Contract is more stringent than the HIPAA Regulations, any safeguard, use or disclosure of PHI by Business Associate shall be made in accordance with such state law.

All contracts entered into by Owner are required under New York State law to contain certain terms and conditions, as set forth in Appendix E hereto and the provisions of such Appendix E are hereby deemed incorporated in this Agreement at this place. The Operator shall comply with such terms and conditions during the Term of this Agreement.

In the event the Subcontractor has an independent notification obligation related to impermissible use or disclosure of PHI in connection with this Agreement or the Services Agreement, the Subcontractor shall promptly notify Business Associate of such obligation and, at least two (2) business days before giving any such notice, the Subcontractor shall notify Business Associate of its intent to provide the required notifications, including any related information required by applicable state law.
