Step 1. Any Employee who has a grievance shall present the grievance verbally to their immediate Supervisor and will be accompanied by a Union Xxxxxxx. The Super- visor shall state his/her decision verbally within five (5) days of such meeting. If this verbal decision does not satisfactorily adjust the grievance, it may be ap- pealed to Step 2 following. Within seven (7) days of receipt of the appeal or within any agreed upon extension, Management designated to handle Step 2 will meet with the grievor and the Union Xxxxxxx in an attempt to resolve the grievance. A written decision shall be given by Management designated to handle Step 2 within seven (7) days of the date of such meeting. If this written decision does not satisfactorily adjust the grievance, it may be appealed to Step 3 following. Notice of appeal must be given in writing by dating and signing the grievance forms within twelve (12) days from the written decision of Management or their designate, to the designated Human Resour- ces representative, setting forth the areas or points of disagreement with the Step 2 written decision. The designated Human Resources representative will arrange to meet with a more senior member(s) of Management and the Union’s designated repre- sentatives, within nine (9) days or a time mutually agreed upon to discuss the grievance. Management will render its decision in writing within nine (9) days from the date of such meeting to the Union. If the Management’s decision does not bring about a satis- factory settlement, the Union may refer the matter to arbitration as provided for in Article 8 within twelve

Step 1. Any Employee who has The parties acknowledge that it is usually most desirable for a grievance teacher and immediate supervisor to resolve problems through free and informal communications. Within fifteen (15) working days of the occurrence of or knowledge of the act or condition which is the basis of the complaint, the grievant shall present the grievance verbally in writing to their immediate Supervisor and the Superintendent, who will be accompanied by arrange for a Union Xxxxxxx. The grievant, an Association representative at the grievants’ option and the Superintendent shall be present for the meeting. Such answer shall include but not be limited to the reasons upon which the decision was based. STEP #2: Appeal to the Board of Trustees. If the grievant is not satisfied with the disposition of the grievance by the Superintendent or if no disposition has been made within the period above provided, the grievance may be submitted by the grievant together with the Association to the Board of Trustees, so long as such appeal is made within five (5) working days of the receipt of the Superintendent’s response at Step # 1. The Board of Trustees shall consider the matter at the next regular meeting, except when the appeal is made less than three (3) working days before such meeting. The Mediator shall not produce any records or testimony nor make any statement with regard to any mediation conducted by him in any forum or proceeding before any court, it may board, investigatory body, arbitrator, or fact finder. STEP #4 Binding Arbitration If the BoPA refuses to assign a mediator or if the assigned mediator determines that the grievance is not likely to be ap- pealed resolved, or after sixty (60) working days, which ever occurs first, the Association shall exercise its right of arbitration by providing the Superintendent with written notice of its intention to Step 2 followingsubmit the grievance to arbitration.
