STEP II. If the grievance is not resolved at Step I, the Association may refer the grievance to the superintendent or the superintendent's official designee within fifteen (15) days after receipt of the Step I answer. The superintendent shall arrange with the Association representative for a meeting to take place within fifteen (15) days of the superintendent's receipt of the appeal. Within ten (10) days of the meeting, the Association shall be provided with the superintendent's written response, including the reasons for the decision.
STEP II. If the Grievance Report Form is not forwarded by either the grievant or the Association to the Superintendent within five (5) days after the receipt of the disposition in Step I, the grievance shall be considered waived and further action barred. If the support teacher is not satisfied with the disposition of the grievance in Step I or if no disposition has been made within the above time limit, the grievant and the Association shall complete Grievance Report Form, Step II, and submit the grievance to the Superintendent. Within five (5) days of receipt, the superintendent and/or his/her designated representative shall meet with the grievant and/or his/her Association representative. Within five (5) days of this meeting, the Superintendent shall give a written disposition of the grievance on the grievance form and forward it to the support teacher. The Association and the principal or supervisor shall be notified in writing of said disposition by the Superintendent.
STEP II. Should a grievance be unresolved at Step I, the Union may refer the matter to Step II by writing to the General Manager, with a copy to the Supervisor within ten (10) working days of receipt of the decision at Step I. Within five (5) working days of receipt of the Union’s referral to Step II, the City Manager or his/her nominee will discuss the grievance with representatives of the Union. Within ten (10) working days of receipt of the Union’s referral to Step II, the General Manager or his/her nominee will submit his/her decision to the Union in writing. Within fifteen (15) working days of receipt of the written reply at Step II, the Union may refer the grievance to arbitration as set out in Article 12.08.
STEP II. 12.5.1 If the employee desires to appeal the grievance to 12.5 - Step II, the grievance shall be reduced to writing, on forms provided, and presented to the Department Director or designee, within five (5) working days following receipt of the immediate supervisor's oral reply.
12.5.2 The written grievance shall contain a complete statement of the grievance, the alleged facts upon which the grievance is based, the reasons for the appeal, the section or sections of the Memorandum of Agreement relied upon or claimed to have been violated, and the remedy requested. The grievance shall be signed and dated by the employee. If an employee is unavailable to sign the grievance, the Business Representative may sign on behalf of the employee. In that event, the grievance must include the name of the employee on whose behalf the grievance is being filed.
12.5.3 The Department Director, or designee, may arrange a meeting between the Department Director or designee, the employee, the appropriate Union representative, and the immediate supervisor to attempt to resolve the grievance. In any event the Department Director, or designee, shall give a written decision to the employee within ten (10) working days following receipt of the written appeal to 12.5 - Step II.
12.5.4 If the employee is not satisfied with the decision, the employee may appeal the grievance to 12.6 - Step III.
STEP II. If the grievant is not satisfied with the disposition of the grievance, or if no disposition has been made within the above stated time limits, the grievant and/or the Association shall complete Grievance Report Form, Step II, within ten (10) school days after notification of Step I disposition and submit the grievance to the Superintendent. Within five (5) school days the Superintendent and/or designated representative shall meet with the grievant and/or his Association representative. Within three (3) school days of the meeting, the Superintendent shall indicate in writing the disposition by completing the appropriate portion of Step II and forwarding it to the grievant. The Association and the administrator shall be notified of said disposition.
STEP II. If the grievant is not satisfied with the disposition at Step I, he/she may within ten (10) days of receipt of the principal's disposition, submit the grievance form to the Superintendent. A meeting shall be mutually arranged within ten (10) days after submittal. Within ten (10) days after the meeting, the Superintendent shall provide the grievant a written disposition on the grievance.
STEP II. In the event the grievant is not satisfied with the decision at Step I, the grievant may appeal the decision on the appropriate form to the department head or the administrator immediately over the immediate supervisor within ten (10) days of receiving the decision at Step I. This statement should include a copy of the original grievance, the decision rendered, and a clear, concise statement of the reasons for the appeal. This administrator shall communicate his/her decision within ten (10) days after receiving the appeal. Either the grievant or the administrator may request a personal conference within the above time limits. If the administrator does not respond within the time limits, the grievant may appeal to the next Step.
STEP II. 24.3.1 Within ten (10) working days of receipt of appeal from Step I, the Superintendent shall submit a written response. If the Superintendent sets a meeting on the grievance, it shall be ten (10) working days thereafter.
24.3.2 If the second step grievance answer is not satisfactory to the Union, the Union may appeal the grievance to arbitration.
STEP II. If after twenty (20) calendar days from the date of the submission of the grievance to the supervisor, or from the date of the supervisor’s reply, the grievance still remains unadjusted, the Association shall have twenty (20) calendar days to present the grievance in writing to the Chief of Police.
22.3.1 The Chief shall have twenty (20) calendar days in which to reply. If the Chief does not respond within the twenty (20) calendar days, or from the date of the Chief’s response, if the grievance remains unadjusted, the Association shall have twenty (20) calendar days to present the grievance to the Bureau of Human Resources.
STEP II. Upon satisfactory completion of the first year’s service, the straight time rate of pay for a employee shall be shown on the pay schedule.
