SUCCESSES AND CHALLENGES. 8. Power reform progress to date in MP has been significant. With support from ADB, Canadian International Development (CIDA) and the Department for International Development of United Kingdom (DFID), GOMP has established an appropriate regulatory framework including an independent sector regulator is in place, MPSEB has been unbundled, assets have been transferred to the newly formed companies and commercial relationships between the companies have been established. Moreover, cost-reflective tariffs have been set for all sector companies and will gradually move to full cost recovery, and capacity is being developed in all companies to operate in the evolving commercial and competitive sector.

In the transport sector, even as the first two phases of the National Highways Development Project (NHDP)—namely, Golden Quadrilateral and the North-South-East-West Corridors—have fallen behind schedule by a few years, the scope of the program has been expanded to include more phases. While ports and airports have continued to benefit from new capacity addition through private participation, Indian Railways (IR) has successfully scripted a turnaround story by adopting a few notable best practices within the extent ownership structure. In the power sector, notwithstanding the presence of a comprehensive legislation (Electricity Act 2003) with several reform-oriented provisions, progress remains elusive in many parts of the country which are plagued by chronic shortages, poor quality, and heavy losses in the distribution segment. Government-owned power utilities in some states, however, seem to have managed to stem the rot for now but it remains to be seen whether they will be able to sustain the achievements and checkmate the risk of policy reversals while they remain under public ownership. The central government has launched the initiative of Ultra Mega Power Projects (UMPPs) to quickly add sizeable generation capacity and quite a few states too are seeking to fill the generation capacity. Following the launch of the Xxxxxxxxxx Xxxxx National Urban Renewal Mission (JNNURM), urban infrastructure came in the limelight, especially in the development of Mass Rapid Transit System in mega cities.

With regard to roads and highways, four-laning of the golden quadrilateral9 is nearing completion. Further, four-laning of 7,166 km under the National Highway Development Program (NHDP)-I and 2,440 km under the National Highway Development Program (NHDP)-II have been completed up to December 2008 as has the four-laning of 7,166km under NHDP-I and 2,440 km under NHDP-II. In the railway sector, the rapid rise in international trade and domestic cargo has placed a great strain on the Delhi-Mumbai and Delhi-Kolkata rail capacity. The Government has, therefore, decided to build dedicated freight corridors in the Western and Eastern high- density routes at an investment of around $5 billion. Requisite surveys and project reports are in progress and work is expected to commence within a year.

  • Assistance in Litigation or Administrative Proceedings Covered Entity shall provide written notice to Business Associate if litigation or administrative proceeding is commenced against Covered Entity, its directors, officers, or employees, based on a claimed violation by Business Associate of HIPAA, the HIPAA Rules or other laws relating to security and privacy or PHI. Upon receipt of such notice and to the extent requested by Covered Entity, Business Associate shall, and shall cause its employees, Subcontractors, or agents assisting Business Associate in the performance of its obligations under the Contract to, assist Covered Entity in the defense of such litigation or proceedings. Business Associate shall, and shall cause its employees, Subcontractor’s and agents to, provide assistance, to Covered Entity, which may include testifying as a witness at such proceedings. Business Associate or any of its employees, Subcontractors or agents shall not be required to provide such assistance if Business Associate is a named adverse party.

  • GRIEVANCE PROCESS RIGHTS No grievant shall lose his/her right to process his/her grievance because of Management-imposed limitations in scheduling meetings.

  • Legal Action If you are dissatisfied with the determination of your claim, and have complied with applicable state and federal law, you are entitled to seek judicial review. This review will take place in an appropriate court of law. Under state law, you may not begin court proceedings prior to the expiration of sixty (60) days after the date you filed your claim. In no event may legal action be taken against us later than three (3) years from the date you were required to file the claim. For members covered by a group (employer sponsored) health plan, your plan may be subject to the Employee Retirement Income Security Act of 1974 (ERISA), as amended. Under federal law, if your plan is subject to ERISA you may have the right to bring legal action under section 502(a) of ERISA after you have exhausted all appeals available under the plan. That means, for both medical and administrative appeals, federal law requires that you pursue a final decision from the plan, prior to filing suit under section 502(a) of ERISA. For a medical appeal, that final decision is the determination of the appeal. You are not required to submit your claim to external review prior to filing a suit under section 502(a) of ERISA. Consult your employer to determine whether this applies to you and what your rights and obligations may be. If you are dissatisfied with the decision on your claim, and have complied with applicable state and federal law, you are entitled to seek judicial review. This review will take place in an appropriate court of law.
