Supply Conditions. The Access Provider shall not be obliged to provide the Call Termination Service to Freephone Numbers until the interconnection link service has been provisioned, and Points of Interconnection established, commissioned and tested.
Supply Conditions. The Access Provider shall not be obliged to provide the Call Termination Service to Mobile Numbers until the SIP Interconnection has been established, commissioned and tested.
Supply Conditions. The Parties shall not be obliged to provide the SMS and MMS Termination Service until the SIP Interconnection has been established, commissioned and tested.
Supply Conditions. The Access Provider shall not be obliged to provide the Call Termination Service to Geographic Numbers until the SIP Interconnection has been established, commissioned and tested.
Supply Conditions. The Access Provider shall not be obliged to provide the Transit Call service until the Joining Circuit Service has been provisioned, and Points of Interconnection established, commissioned and tested.
Supply Conditions. BioNumerik agrees to supply Takeda the Product in a final packaged form suitable for distribution to wholesalers, distributors, cooperative purchasing groups, pharmacies or hospitals at the Provisional Price to Takeda. The conditions for the supply from BioNumerik to Takeda are prescribed in Exhibit A to this Agreement.
Supply Conditions. 6.1 The Customer Agreement is governed by:
6.1.1 the Supply Conditions in Schedule 4 of the Agreement;
6.1.2 any applicable terms and conditions of the Agreement; and
6.1.3 the special terms (if any) set out in Item 9 of the Table (“Special Terms”).
6.2 The Special Terms do not prevail if they are inconsistent with the terms and conditions of the Agreement (including the Supply Conditions); unless the prior written approval of the Principal’s Contract Administrator has been obtained.
Supply Conditions. The Seller will make Gas available for supply at the Delivery Point up to the total Annual Contract Quantity (“ACQ”) in any Contract Year and up to the Maximum Daily Quantity (“MDQ”) on any day. Failure to supply by reason of Permitted Interruptions or Force Majeure shall not result in a liability from the Seller to the Buyer.

The performance of the vendors shall be assessed on the following criteria: Services will be required 24 X7 for which communication channel should be open. Drugs have to be supplied through special messengers of the supplier. Supply register will be maintained by the CMS pharmacists concerned. The vendor or its representative while making deliveries shall sign (with date and time) on receipt register or challan. Any entry into the register/challan shall be the final proof of supply. The authorized representative of the vendor making supply can see the performance register. Entries in the register shall be final and shall not be put to question in any dispute. • Failure to supply in time or compromise in quantity and quality shall lead to termination of the contract. • In case of non-availability of items with empanelled supplier; it shall be the responsibility of Suppliers to procure the item from other sources and supply the same at the approved (L1) rate. • The payment will be made on submission of bills in triplicate to Principal cum Chief Superintendent, Jorhat Medical College & Hospital, Jorhat. The payment will be released on availability of the particular fund in JMCH. • Empanelment will be valid for a period of one year. • Order for supply against a particular item will be placed on the vendor as per rotation and periodicity fixed by JMCH.
Supply Conditions. Kissei shall deliver the Compound [*] as per ICC Incoterms 2010 for the commercial Product during the Royalty Term and the Compound [*] as per ICC Incoterms 2010 for commercial Product after the Royalty Term, sample use and the development use after the first Marketing Approval. The shipment place shall be determined by the Parties. The details of the terms and conditions for the supply of the Compound shall be stipulated in the separate agreements referred to in Section 9.01, which shall be entered into by the Parties in due course.
