Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, or where a Teacher takes parental leave pursuant to clause 19.2 or clause 19.3, the Teacher shall be paid salary calculated in accordance with this clause as follows: If the leave without pay commences and concludes in the same school year:
(i) subject to clause 17.6 (a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and
(ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made:
(A) at the commencement of the leave in respect of that year; and
(B) at the end of Term IV in accordance with clause 17.6(c). If the leave without pay is to conclude in a school year following the school year in which the leave commenced:
(i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and
(ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. The payment to be made to a Teacher at the conclusion of Term IV of a school year:
(i) pursuant to clause 17.6(a)(ii)(B);
(ii) or in circumstances where, with the agreement of the School, a Teacher who has been paid pursuant to clause 17.6(b)
(i) returns from leave during the school year in which the leave commenced and not withstanding that as a result did not in total exceed 20 pupil days, shall be determined by:
(A) applying the formula in clause 17.3 as if no payment had been made to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i); and
(B) deducting from that amount the amount paid to the Teacher pursuant to clause 17.6(a)(ii)(A) or clause 17.6(b)(i). Notwithstanding the provisions of clause 17.3(a) a Teacher shall not, pursuant to this clause be paid an amount in respect of a year of employment which is less than the amount to which the Teacher would otherwise be entitled under the provisions of the Act, in respect of a year of employment.
Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds 20 pupil days in any year, the Teacher shall be paid salary calculated in accordance with this clause as follows: If the leave without pay commences and concludes in the same school year:
(i) subject to clause 17.6(a)(ii) below, the payment shall be calculated and made at the conclusion of Term IV of that school year; and
(ii) if the leave without pay commences on the day following the last teaching day of a term and concludes on the day preceding the first teaching day of a term in the same year a payment shall be calculated and made:
(A) at the commencement of the leave in respect of that year; and
(B) at the end of Term IV in accordance with clause 17.6(c). If the leave without pay is to conclude in a school year following the school year in which the leave commenced:
(i) at the commencement of the leave, a payment shall be calculated and made in respect of the school year in which the leave commences; and
(ii) at the end of Term IV in the school year in which the leave concludes, a payment shall be calculated and made in respect of that school year. The payment to be made to a Teacher at the conclusion of Term IV of a school year:
Teachers Who Take Approved Leave Without Pay. Where a Teacher takes leave without pay with the approval of the School for a period which [in total] exceeds ten required attendance days in any year, the Teacher shall be paid a salary calculated in accordance with this clause as follows: If the leave without pay commences and concludes in the same School Year:
(i) subject to sub-clause 44.5(a)(ii) below, the payment shall be calculated and made at the conclusion of Term Four of that School Year; and
Teachers Who Take Approved Leave Without Pay. Where a Teacher takes approved leave without pay for a period which (in total) exceeds more than two term weeks in any School Year, the Teacher will be paid an amount calculated in accordance with this clause as follows:
(a) if the leave without pay commences and concludes in the same School Year, the payment will be calculated and made at the conclusion of the last school term or final semester in that year; and
(b) if the leave without pay is to conclude in a School Year following the School Year in which the leave commenced:
(i) at the commencement of the leave, a payment will be calculated and made in respect of the School Year in which the leave commences; or
(ii) at the end of the last term or final semester in that year in which the leave concludes, a payment will be calculated and made in respect of that School Year.
(c) If the Teacher returns early from leave, any payment under this clause will be taken into account in calculating the amount owed to the Teacher at the end of the School Year.
