TECHNICAL AND OPERATIONAL REQUIREMENTS. The Parties agree that the engineering, construction, testing and commissioning of the Renewable Energy Installation shall be carried out in accordance with the T&O Rules. The Feed-in Approval Holder further agrees to provide the Distribution Licensee, its employees, officers and agents unrestricted access to the Interconnection Facilities and Communication Facilities at all reasonable times upon giving reasonable notice (other than in the case of an emergency condition when immediate access will be given) so as to enable the Distribution Licensee to comply with the provisions of this Agreement and applicable laws. The Distribution Licensee, its employees, officers and agents shall at all times be subject to the Feed-in Approval Holder’s safety rules and regulations and shall exercise such access rights in a manner that will not interfere with the operation of such facilities and the Renewable Energy Installation.

CLAUSE 10: FORCE MAJEURE EVENT Neither Party shall be liable for any delays or omissions to the extent they result from events or circumstances beyond their control such as, but not limited to, natural disasters, strikes, war, riots etc. If a Force Majeure Event results in the revocation of the Feed-in Approval due to the failure by the Feed-in Approval Holder to meet its minimum performance threshold as stipulated in such Feed-in Approval, this Agreement shall automatically terminate upon the date specified in a notice from the Authority to the Parties confirming such revocation.

The requirements for Tandem Switching include, but are not limited to the following: 4.3.2.1.1 Tandem Switching shall provide signaling to establish a tandem connection; 4.3.2.1.2 Tandem Switching will provide screening as jointly agreed to by Louisville Telephone and BellSouth; 4.3.2.1.3 Tandem Switching shall provide Advanced Intelligent Network triggers supporting AIN features where such routing is not available from the originating end office switch, to the extent such Tandem switch has such capability; 4.3.2.1.4 Tandem Switching shall provide access to Toll Free number database; 4.3.2.1.5 Tandem Switching shall provide connectivity to PSAPs where 911 solutions are deployed and the tandem is used for 911; and 4.3.2.1.6 Where appropriate, Tandem Switching shall provide connectivity for the purpose of routing transit traffic to and from other carriers. 4.3.2.2 BellSouth may perform testing and fault isolation on the underlying switch that is providing Tandem Switching. Such testing shall be testing routinely performed by BellSouth. The results and reports of the testing shall be made available to Louisville Telephone. 4.3.2.3 BellSouth shall control congestion points and network abnormalities. All traffic will be restricted in a non-discriminatory manner. 4.3.2.4 Tandem Switching shall process originating toll-free traffic received from Louisville Telephone’s local switch. 4.3.2.5 In support of AIN triggers and features, Tandem Switching shall provide SSP capabilities when these capabilities are not available from the Local Switching Network Element, to the extent such Tandem Switch has such capability.
