Tenant Personal Property. Provided that no Event of Default then exists, in connection with the surrender of the Premises, Tenant may upon at least five (5) Business Days prior notice to Landlord remove from the Premises in a workmanlike manner all Tenant Personal Property, leaving the Premises in good and presentable condition and appearance, including repairing any damage caused by such removal; provided that Landlord shall have the right and option to purchase for itself or its designee the Tenant Personal Property for its then fair market value during such five (5) Business Day notice period, in which case Tenant shall so convey the Tenant Personal Property to Landlord or its designee by executing a xxxx of sale in a form reasonably required by Landlord. If there is any Event of Default then existing, Tenant will not remove any Tenant Personal Property from the Premises and instead will, on demand from Landlord, convey it to Landlord or its designee for no additional consideration by executing a xxxx of sale in a form reasonably required by Landlord. Title to any Tenant Personal Property which is not removed by Tenant as permitted above upon the expiration of the Term shall, at Landlord’s election, vest in Landlord or its designee; provided, however, that Landlord may remove and store or dispose at Tenant’s expense any or all of such Tenant Personal Property which is not so removed by Tenant without obligation or accounting to Tenant.

Tenant Personal Property. Tenant shall install, affix, assemble or place on the Premises all items of furniture, fixtures, equipment and supplies not included as Landlord Personal Property as Tenant reasonably considers to be appropriate for Tenant's use of the Premises as contemplated by this Lease (the "Tenant Personal Property"). Tenant shall provide and maintain during the entire Term all Tenant Personal Property as shall be necessary in order to operate the Premises in compliance with all requirements set forth in this Lease. All Tenant Personal Property shall be and shall remain the property of Tenant and may be removed by Tenant upon the expiration of the Term. However, if there is any Event of Default, Tenant will not remove the Tenant Personal Property from the Premises and will on demand from Landlord, convey the Tenant Personal Property to Landlord by executing a bxxx of sale in a form reasonably required by Landlord. In any event, Tenant will repair all damage to the Premises caused by any removal of the Tenant Personal Property.
Tenant Personal Property. Tenant shall obtain and install all items of furniture, fixtures, supplies and equipment not included as Landlord Personal Property as shall be necessary or reasonably appropriate to operate each Facility in compliance with this Lease (the “Tenant Personal Property”).
Tenant Personal Property. Insurance covering all of Tenant's trade fixtures, merchandise and other personal property from time to time in the Premises in an amount equal to their full replacement cost from time to time, providing protection against the "risks of physical damage" as provided in the ISO Causes of Loss -- Special Form (CP 10 30), or equivalent insurance company form. The proceeds of such insurance shall, so long as this Lease remains in effect, be used to repair or replace the property damaged or destroyed, as determined by Tenant.
Tenant Personal Property. Xxxxxx’s personal property and any other personal property permitted on Premises by Xxxxxx, except that which may be the personal property of the Owner of Premises, is on Premises at Tenant’s own risk and Landlord shall not be liable for any loss or damage of same, including but not limited to food spoilage, whether arising from criminal acts, fire, storm, flood, rain, wind damage, acts of God, acts of negligence by any other person, bursting or leaking of water pipes, roof leaks, interruption of utility services, insect infestations, or failure of appliances or other systems.
Tenant Personal Property. However, if there is any Event of Default which is continuing, Tenant will not remove the Tenant Personal Property from the Premises and will on demand from Landlord, convey (subject to any existing security interest thereon) the Tenant Personal Property to Landlord by executing a bill xx sale in a form reasonably required by Landlord. Upon any such conveyance of Tenant Personal Property to Landlord, the amount owing by Tenant to Landlord by reason of the applicable Event of Default shall be reduced by the fair market value of such Tenant Personal Property, net of any associated debt assumed by Landlord. Such fair market value shall be established by agreement of the parties, but failing such agreement, within ten (10) days of request by any party, such fair market value shall be established by the appraisal process set forth in Exhibit C. In any event, Tenant will repair all damage to the Premises caused by any removal of the Tenant Personal Property.
Tenant Personal Property. Except to the extent expressly provided in this Lease, Landlord shall have no rights to Tenant Personal Property and, provided no Event of Default shall have occurred and be continuing at the time, Tenant shall have the right to remove all Tenant Personal Property from the Premises at the expiration or sooner termination of this Lease. Tenant may remove items of Tenant Personal Property from time to time during the Term, provided that any such Tenant Personal Property as is then required, necessary or appropriate for Tenant’s operation of the Facility from which such items are removed for its Primary Intended Use shall be replaced by like items as are then required, necessary or appropriate for the operation of the Premises in accordance with the terms of this Lease.
Tenant Personal Property.
