TERM AND SCHEDULE. 5.1. If the LPA has the plans, special provisions, and cost estimate (list of pay items, quantities, and unit prices) for the Project ready such that federal funds can be obligated (INDOT obligates the funds about 7 weeks before the date bids are opened for the construction contract), between July 1, 2024 and June 30, 2025, INDOT will make the federal funds shown in Section I.A. and/or Section I.B. of Attachment A available for the Project, provided the Project is eligible, and provided the federal funds shown in Section I.B. of Attachment A are available.
TERM AND SCHEDULE. 6.1 Consultant shall not perform any Services hereunder until receipt of written Notice to Proceed from the District. The term of this Agreement shall begin upon performance of the Services hereunder, and shall, unless extended by the District, or unless sooner canceled or terminated pursuant to the provisions hereof, expire on upon successful completion of the Services.

TERM AND SCHEDULE. The term of this Contract shall be from the date of the last signature affixed to this Contract to the earlier of December 31st of the second year after the programmed construction year of 20 or final project audit. A schedule for completion of the services and deliverables is described in Attachment E (Major Milestones and Project Schedule), herein attached and made an integral part of this Contract.

A detailed project schedule is presented on the attached Appendix A. However, it is understood by the parties that the actual schedule may differ from what is anticipated. The City shall advise the Consultants in writing of each change in the schedule as soon as feasible after it becomes aware thereof, and the Consultants shall adjust the timing of their services so as to comply with the revised schedule. The Consultants shall provide their services at such times as are necessary in order to promote the smooth progress of the Project.

The “Service Term” shall be the initial period of 20 years Section 2.1 commencing on the Service Commencement Date, unless terminated earlier in accordance with the terms and conditions of this Agreement. If the Parties mutually agree, the Service Term may be extended by one additional 5-year term. The term of this Agreement shall commence on the Effective Date and terminate on the expiration of the Service Term, unless terminated earlier in accordance with the terms and conditions of this Agreement.
