Terms and Conditions of Application. The parties hereto expressly agree that the Application sets forth the overall goals, standards and general operational policies of CHARTER SCHOOL, and that the Application is not a complete statement of each detail of CHARTER SCHOOL’s operation. To the extent CHARTER SCHOOL desires to implement specific policies, procedures, or other specific terms of operation that supplement or otherwise differ from those set forth in the Application, CHARTER SCHOOL shall be permitted to implement such policies, procedures, and specific terms of operation, provided that such policies, procedures, and specific terms of operation are consistent with the goals, standards and general operational policies set forth in the Application, this Agreement, and the Act, and provided that such policies, procedures, and specific terms of operation (a) are not otherwise prohibited or circumscribed by applicable law or this Agreement, or (b) are not materially different from those set forth in this Agreement and the Application. To the extent there is a conflict between the terms of this Agreement and the Application, the terms of this Agreement shall govern.

Notwithstanding, to the extent that the Application or any Exhibit attached to the body of this Agreement contradicts the terms and provisions set forth in the body of this Agreement (and specifically, paragraphs 2 through 28 of this Agreement), the terms and provisions set forth in the body of this Agreement shall control.
Terms and Conditions of Application. 21.07.1 Employees must submit a written request for leave without pay six (6) months before the leave is to commence. An employee may derogate from this notice period in an emergency, but must always submit his request as soon as possible.
21.07.2 The employee’s request must state:
(i) the specific reasons for the leave; and
(ii) the desired duration of the leave.
21.07.3 Approval of requests for leave must be made in writing and state the date on which the leave begins and the anticipated date of its expiration.

The terms of this stipulation are regulated by applicable Collective Employment Agreements. Parties agree that if a new Collective Employment Agreement would limit the terms of this stipulation, this stipulation will be transformed within the bounds of this new Collective Employment Agreement.

The Parties hereto expressly agree that the Application (a copy of which is attached hereto and incorporated herein as Attachment A) and the Renewal Application (a copy of which is attached hereto and incorporated herein as Attachment B) set forth the overall goals, standards and general operational policies of XxXX, and that the Application and the Renewal Application are not complete statements of each detail of the operation of XxXX. To the extent that XxXX desires to implement specific policies, procedures or other specific terms of operation that supplement or otherwise differ from those set forth in the Application or the Renewal Application, XxXX shall request permission from the Board for a waiver to implement such policies, procedures, and specific terms of operation, provided that such policies, procedures and terms of operation are (i) not otherwise prohibited or circumscribed by law, Board Policy, or this Agreement, and (ii) not materially different from those set forth in this Agreement. The Board, in its sole discretion, shall decide whether to grant any waiver(s) requested by XxXX.

To the extent that MMCI desires to implement specific policies, procedures or other specific terms of operation that supplement or otherwise differ from those set forth in the Application, MMCI shall be permitted to implement such policies, procedures, and specific terms of operation, provided that such policies, procedures and terms of operation are (i) not otherwise prohibited or circumscribed by law, Board Policy, or the Charter, and (ii) are not materially different from those set forth in the Charter.
