TEST OF WELL ECONOMY. 32.01 For purposes of this lease, if a gas well does not produce more than an average of one (1) Mcf/day of natural gas in a calendar year (calculated by dividing its annual production in Mcf by 365 days), it shall be considered uneconomic (i.e., not in paying quantities) to maintain and operate; and if during the following calendar year gas production from the well also fails to exceed a one (1) Mcf/day average, Lessee shall plug and abandon the well as per Section 33 (Plugging), and restore the wellsite and access road to the satisfaction of District Forester, all no later than six (6) months after the end of the following calendar year. This provision shall apply to all xxxxx drilled or operated by Lessee on the leased premises, whether the xxxxx are shut-in or producing, unless the Department has informed the Lessee that a well or xxxxx falls under the provisions of Section 30 (Gas Storage Rights). Department may, at its sole option and in writing, waive all or part of the requirements of this provision to Lessee, if in Department’s judgment such a waiver is warranted by economic conditions or other circumstances, and is deemed to be in the best interest of the Commonwealth.

TEST OF WELL ECONOMY. 9.1 For purposes of this Lease, if a gas well associated with the Leased Premises does not produce more than an average of one thousand cubic feet per day (Mcf/day) of natural gas during two consecutive calendar years (calculated by dividing its annual production in Mcf by 365 days), it shall be considered uneconomic to maintain and operate. Lessee shall plug and abandon the well as per Paragraph 28 (Plugging), and restore the well site, access road and any associated pipeline right-of-way to the satisfaction of the District Forester, all within a timeframe established by the Department. 9.2 This provision shall apply to all xxxxx associated with the Leased Premises, whether the xxxxx are shut-in or producing, unless the Department has informed the Lessee that a well or xxxxx fall under the provisions of Paragraph 35 (Gas Storage Rights). 9.3 The Department may, in its sole discretion and in writing, waive all or part of the requirements of this provision, if in the Department’s judgment such a waiver is warranted by economic conditions or other circumstances and is deemed to be in the best interest of the Commonwealth.

  • CONTRACT WORK HOURS AND SAFETY STANDARDS As per the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701-3708), where applicable, all Customer Purchase Orders in excess of ,000 that involve the employment of mechanics or laborers must include a provision for compliance with 40 U.S.C. 3702 and 3704, as supplemented by Department of Labor regulations (29 CFR Part 5). Under 40 U.S.C. 3702 of the Act, each contractor must be required to compute the wages of every mechanic and laborer on the basis of a standard work week of 40 hours. Work in excess of the standard work week is permissible provided that the worker is compensated at a rate of not less than one and a half times the basic rate of pay for all hours worked in excess of 40 hours in the work week. The requirements of 40 U.S.C. 3704 are applicable to construction work and provide that no laborer or mechanic must be required to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous. These requirements do not apply to the purchases of supplies or materials or articles ordinarily available on the open market, or contracts for transportation or transmission of intelligence.

  • Contract Work Hours and Safety Standards Act The following clauses apply to any Federal-aid construction contract in an amount in excess of $100,000 and subject to the overtime provisions of the Contract Work Hours and Safety Standards Act. These clauses shall be inserted in addition to the clauses required by 29 CFR 5.5(a) or 29 CFR 4.6. As used in this paragraph, the terms laborers and mechanics include watchmen and guards.

  • Electrical appliance safety The Hirer shall ensure that any electrical appliances brought by them to the premises and used there shall be safe, in good working order, and used in a safe manner in accordance with the Electricity at Work Regulations 1989. Where a residual circuit breaker is provided the hirer must make use of it in the interests of public safety.

  • Joint Occupational Health and Safety Committee The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. The parties agree that a Joint Occupational Health and Safety Committee shall be established for each Employer covered by this Collective Agreement. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers’ Compensation Act. The Committee shall be as between the Employer and the Union, with equal representation, and with each party appointing its own representatives. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Union further agrees to actively pursue with the other Health Care Unions a Joint Union Committee for the purposes of this Article. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently.   • Safety Measures Awarded vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Awarded vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage.

Customers will electronically submit the completed Contractor Performance Survey(s) to the Department Contract Manager no later than the due date indicated in Contract Exhibit D, Section 17, Additional Special Contract Conditions. The completed Contractor Performance Survey(s) will be used by the Department as a performance-reporting tool to measure the performance of Contractors. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MyFloridaMarketPlace or on the Department's website).
