Common use of Tires Clause in Contracts

Tires. 5.1. The User, at its expense, shall provide proper maintenance to tires including but not limited to proper inflation, repair of flat tires, pulled valve stems, etc. 5.2. In the event of a blowout and/or total failure of a tire after Interchange, the User shall make repairs at User’s expense. The replacement tire shall be properly mated. The User will return the blown out or unserviceable tire with the Equipment and shall retain the replacement tire upon redelivery of the Equipment to the Owner. 5.3. In the event of failure to return the blown out or unserviceable tire, failure to provide proper maintenance, or if the tire is ruined as a result of being run flat or otherwise abused, the User shall reimburse the Owner for the replacement value of the tire as of the time of original Interchange. In the absence of specific information the value shall be U.S.$150.00 (One Hundred Fifty U.S. Dollars) per tire.
