Common use of Transfers to Positions Outside of the Bargaining Unit Clause in Contracts

Transfers to Positions Outside of the Bargaining Unit. (a) A nurse who is transferred to a position outside of the bargaining unit shall continue to accrue seniority for a period of up to twelve (12) months, and shall not suffer any loss of service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of more than 12 months, but not more than 24 months, shall retain, but not accumulate seniority. A nurse must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or the nurse will lose all seniority held at the time of the subsequent transfer. (b) In the event that a nurse is transferred to a position outside of the bargaining unit for more than 24 months, the nurse will lose all seniority held at the time of transfer.
