Transmission of Electronic Data. 7.2.1 Design-Builder shall comply with the requirements of UW CAD, BIM and PDF Standards and Requirements, and Owner and Design-Builder shall otherwise agree on all other Electronic Data protocols. Each party shall be responsible for securing the legal rights to access the agreed- upon format, including, if necessary, obtaining appropriately licensed copies of the applicable software or electronic program to display, interpret and/or generate the Electronic Data.
7.2.2 Neither party makes any representations or warranties to the other with respect to the functionality of the software or computer program associated with the electronic transmission of Work Product. Unless specifically set forth in the Agreement, ownership of the Electronic Data does not include ownership of the software or computer program with which it is associated, transmitted, generated or interpreted.

The rights in the Electronic Data shall be as set forth in Article 4 of the Agreement. Transmission of Electronic Data. 3.1 Xxxxxxx Futures shall not be liable to the Customer for any Loss suffered or incurred by the Customer due to any inability of the Customer to access the Electronic Broking Facilities for any reason whatsoever, or for any errors, defect, malfunction or failure (whether total or partial) of the Electronic Broking Facilities (or any part thereof) or interruption or delay in response time of the Electronic Broking Facilities whether resulting or arising from any repair or servicing of the Electronic Broking Facilities; any damage, destruction, breakdown, mechanical or other defect, howsoever caused, to the Electronic Broking Facilities (or any part thereof); any corruption or damage to the Electronic Broking Facilities (or any part thereof); any failure by Xxxxxxx Futures, its officers, employee, agents or servants to receive the Customer’s instructions or Orders notwithstanding that the instruction or Order has been received by the Electronic Broking Facilities; or, any other cause whatsoever.

Transmission of Electronic Data. User understands that the technical processing and transmission of User’s electronic data is fundamentally necessary to use of certain aspects of the Service. User expressly consents to BES+Tech’s receiving and storage of User’s Electronic Data and User acknowledges and understands that use of the User’s Electronic Data will involve transmission over the Internet, and over various networks, only part of which may be owned and/or operated by BES+Tech. User further acknowledges and understands that Electronic Data may be accessed by unauthorized parties when communicated across the Internet, network communications facilities, telephone or other electronic means. BES+Tech is not responsible for any Electronic User Data which are delayed, lost, altered, intercepted or stored during the transmission of any data whatsoever across networks not owned and/or operated by BES+Tech, including, but not limited to, the Internet and User’s local network.
