Underground Parking. Subject to this Section 1.3, Landlord will make available to Tenant during the Term (and any period of Early Occupancy), at no additional cost to Tenant (other than Tenant’s payment of all Rent otherwise due under this Lease), all 46 automobile parking spaces in the Building’s underground parking area (“Tenant Reserved Spaces”), which Tenant Reserved Spaces will be for the exclusive use of Tenant. Landlord will not permit any person or entity other than Tenant to use the Tenant Reserved Spaces for any purpose during the Term (or any period of Early Occupancy).

Underground Parking. Tenant shall have the use of seven (7) underground parking spaces which shall be assigned to Tenant by Landlord.
Underground Parking. So long as Tenant in not in default under the Lease, Landlord shall allocate to Tenant five (5) parking spaces in the lower level indoor parking area of Executive Plaza for the term of the lease at no charge to Tenant. Except as otherwise expressly set forth in this Section 28, the terms and conditions of Tenant’s use of said parking space shall be governed by that certain Application and Lease for Executive Plaza Lower Level Indoor Parking executed by Tenant and Landlord.
Underground Parking. Developer recognizes that the proposal to install underground parking will require extensive excavation within the Development, and that a good portion of the development sits on pot rock that may be difficult to remove. Developer is prohibited from blasting pot rock in order to clear and excavate areas for parking. Should removal of pot rock require blasting, or become too costly to justify the expense, the Developer will lose the density associated with the parking that is unavailable unless Developer proposes a redesign that meets existing zoning and setbacks, and replaces the lost parking. Such proposal shall require approval of the Midway City Council. Regardless of circumstance, no building will be allowed to exceed 35’ feet in height, meaning that if underground parking is not possible, and above ground parking on the street level is the only option, a loss of one of the stories of livable square footage in that unit will be the natural consequence of not being able to put the parking underground.
