Uniform Codes. Notwithstanding any other provision of this Agreement, City may apply to the Project Site, at any time during the Term, the then current Uniform Building Code and other uniform construction codes as properly modified by City and uniformly applied on a citywide basis, and City’s then current design and construction standards for road and storm drain facilities. In no event shall any such uniform code or standard be adopted for the purpose of preventing or otherwise limiting construction of all or any part of the Project.

Uniform Codes. Uniform building, electrical, mechanical, fire and similar codes based upon uniform codes (including any City amendments) adopted in, or incorporated by reference into the BMC, as may be enacted or amended thereafter and as in effect on a citywide basis.
Uniform Codes. Changes adopted by the International Conference of Building Officials, or other similar body, as part of the then most current versions of the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Mechanical Code, or National Electrical Code, or other such Uniform Codes, and also adopted by City as Subsequent Land Use Regulations, but only if: (i) the Project is not subjected to the 2019 codes pursuant to Section 3.5 of this Agreement; and (ii) such changes are applicable City-wide.
Uniform Codes. This Agreement does not prevent the City from adopting and amending in compliance with State law certain uniform codes or uniform standards which are based on recommendations of a multi-state professional organization and which become applicable throughout the City -- including the Project and the Property subject to this Agreement. Such Uniform Codes include, but are not limited to, the Uniform Building Code, Uniform Mechanical Code, National Electrical Code, Uniform Fire Code, and uniform standards for the construction of public works.

Uniform Codes. Notwithstanding subdivision (1) of the Section 4.02 (a), development of the Project shall be subject to changes occurring from time to time in the provisions of the City's building, mechanical, plumbing, fire and electrical regulations which are based on the recommendations of a multi-state professional organizations and become applicable through the City, including, but not limited to, the Uniform Building Code (now known as the California Building Code) and other similar or related uniform codes (the "Uniform Codes"), provided that: (A) Such Uniform Codes shall apply to the Project only to the extent that the applicable code (and the applicable version or revision of the code) has been adopted by City and is in effect on a City-wide basis; (B) Such Uniform Codes shall be interpreted and applied to construction of the Project in a reasonable manner consistent with the provisions and limitations in the particular code provision(s) adopted by City; and (C) The provisions of such Uniform Codes shall be interpreted and applied to the Project in a manner consistent with the generally prevailing interpretation of the same provision under the State Building Standards Code set forth in Title 24 of the California Code of Regulations.

Notwithstanding the foregoing, with respect to any local “reach codes” adopted by City after the Effective Date (including, without limitation, any local measures to restrict use of natural gas or require on-site renewable energy generation, or to require energy efficiency measures beyond Title 24 requirements), (i) Developer shall be excused from compliance with such reach codes for the first two buildings of the Project as set forth in the Phase 2 Precise Plan, and (ii) regardless of whether Developer has submitted a complete Precise Plan application for a phase of the Project prior to the effective date of any reach codes, City may, at any time, excuse Developer from compliance with such reach codes on the basis of a written good faith assessment by Developer that compliance will not be feasible, including for technological or financial reasons, or that compliance would frustrate the goals of the Project Approvals or this Agreement. Prior to submitting a written good faith assessment of reach code feasibility to City, Developer shall confer in good faith with Peninsula Clean Energy, or a qualified third-party consultant with subject matter expertise as reasonably identified by City, regarding feasibility of both full and partial compliance with the reach code, including technological and financial feasibility, and shall include the feasibility assessment of Peninsula Clean Energy or the other consultant identified by City. Notwithstanding the foregoing, Developer shall be excused from compliance with such reach codes if the Project is otherwise exempt under the terms of the reach codes.

Uniform Codes. The County may apply the then-current 15 Washington State Building Code, Chapter 19.27 RCW, and other uniform construction 17 codes to new applications for building permits necessary for the development of The 18 Expansion throughout the Term of this Agreement, provided that any such uniform code 19 shall apply to The Expansion only to the extent that the code has been adopted by the County for application on a county-wide basis.
Uniform Codes. The County may apply the then-current Washington State Building Code, Chapter 19.27 RCW, and other uniform construction codes to new applications for building permits necessary for the development of MountainStar throughout the Term of this Agreement, provided that any such uniform code shall apply to MountainStar only to the extent that the code has been adopted by the County for application on a county-wide basis.
