Common use of Unused Vacation Clause in Contracts

Unused Vacation. 10.13.1 It is understood that to meet compelling operational needs, the District may, from time to time, prevent employees from taking their scheduled vacation days earned during the fiscal school year. Upon that happening, the unused vacation days may be "banked" by the employee or carried over for use up through December 31 of the same year in which the carry-over occurs. 10.13.2 It is further understood that unusual or extenuating circumstances may cause the need to allow the employee to carry over vacation days earned during the fiscal school year. These days may be carried over for use through December 31 of the same year in which the carryover occurs. Such exceptions shall be mutually agreed upon by the employee and the District and, when made, shall not be considered as establishing precedent. 10.13.3 It is understood that if an employee plans to carry-over vacation time the employee will submit a completed absence report to the District by September 30 identifying the dates the “banked” vacation will be used. 10.13.4 Without exception, the District, shall schedule employees’ “banked” vacation on October 1 of each year if the employee fails to submit an absence report identifying the dates the “banked” vacation will be used. 10.13.5 All banked vacation shall be used by December 31 of the year in which the carry- over occurs. There will be no compensation for unused vacation.
