Use of Aggregated Data. AMCA will disclose aggregated data from all reporting companies to each company that reports. AMCA will also endeavor to estimate sales of non-reporting companies, which it will report to all reporting companies. Aggregated and estimated sales and employment data will not be treated as confidential information, and will be used in support of AMCA’s lobbying efforts on behalf of the Air Movement and Control industry, fighting for reasonable standards, codes and Department of Energy efficiency regulations.

Use of Aggregated Data. The Company shall have the right to collect and analyze data and information related to Client’s use of the Services that is used by Company in an aggregate and anonymized manner as set out in this Section (the “Aggregated Data”). As between the Company and Client, all right, title, and interest in Aggregated Data—provided that it cannot identify Client, any Authorized User, or Client’s Confidential Information—belong to and are retained solely by the Company for support, enhancement, and provision of the Services. Client acknowledges that the Company will be free (during and after the Services Period) to: (i) use Aggregated Data to improve and enhance the Services and for other development, diagnostic, and corrective purposes in connection with the Services and other Company ventures; and (ii) disclose Aggregated Data in connection with the Company’s business, subject to any applicable privacy laws, and use the Aggregated Data for any other lawful purpose.
Use of Aggregated Data. Customer grants CyberArk the right to collect and use anonymized generic statistical information derived from such Customer Meta-Data (but not the Customer Data itself) and aggregate it with statistical information from other customers (“Non-Identifiable Aggregated Data”) for CyberArk’s reasonable business purposes, including without limitation for analyzing customer needs and improving the Services.
Use of Aggregated Data. As between ProcStep and Customer, ProcStep owns any data created or collected by ProcStep in its operation of the Service (other than Customer Data) and the aggregated and statistical data derived from the operation of the Service (such as the number of records in the Service, the number and types of transactions, configurations, and reports processed in the Service and the performance results for the Service) (collectively, the “Aggregated Data”). Nothing herein shall be construed as prohibiting ProcStep from utilizing the Aggregated Data for purposes of operating ProcStep’s business, provided that ProcStep’s use of Aggregated Data will not reveal the identity, whether directly or indirectly, of any individual. In no event does the Aggregated Data include any personally identifiable information.
