Common use of Use of Past Record Clause in Contracts

Use of Past Record. In imposing any discipline on a current charge, the Employer will not take into account any prior infractions which occurred more than three (3) years previously, nor impose discipline on an employee for deliberate errors or mistakes on the employment application after a period of three (3) years from the date of hire, provided that there has been no reoccurrence of any behavior which resulted in discipline.
