Use of the Infrastructure. 2.1. In consideration for your acceptance of the Terms and subject always to your continuing compliance with these Terms, Arkadiah grants you the limited, revocable, personal, non-transferable, non-sublicensable and non-exclusive right to access and/or use the Infrastructure. 2.2. You shall not access and/or use the Infrastructure in any manner that may impair, overburden, damage, disable or otherwise compromise the Infrastructure, or interfere with other users. 2.3. When you access and/or use the Infrastructure, you agree and undertake to comply with the following provisions: 2.3.1. during the access to and/or use of the Infrastructure, all activities you carry out should comply with the requirements of Applicable Law and regulations, these Terms, various guidelines rules and/or policies of Arkadiah and Applicable Licenses; 2.3.2. your use of the Infrastructure should not violate public interests, public morals, or the legitimate interests of others; and 2.3.3. unless otherwise provided for in the Applicable Licenses, without prior written consent from Arkadiah, you shall not knowingly or otherwise, authorise, allow or assist any other party to : (i) copy, modify, reproduce, translate, localize, port or otherwise create derivatives of any part of the Infrastructure; (ii) reverse engineer, disassemble, decompile or otherwise attempt to discover the source code or structure, sequence and organization of all or any part of the Infrastructure (except that this restriction shall not apply to the limited extent restrictions on reverse engineering are prohibited by applicable local, state, provincial, national or other law, rule or regulation); (iii) rent, lease, resell, distribute, use in any unauthorized or unintended manner or otherwise exploit the Infrastructure for purposes not contemplated by the Terms; (iv) remove or alter any proprietary notices, Trademarks or labels on or in the Infrastructure; and

Use of the Infrastructure. 3.1. Our Responsibilities. We shall: (i) provide Our support for the features on the Exigo Office Suite Features document to You at no additional charge (except support for Custom Services and/or custom programming such as compensation plan programming), (ii) use commercially reasonable efforts to make the Infrastructure available 24 hours a day, 7 days a week, except for: (a) planned downtime or “greyouts” (which We shall schedule to the extent practicable after hours or during the weekend hours), or (b) any unavailability caused by circumstances beyond Our reasonable control, including without limitation, acts of God, acts of government, floods, fires, tornados, earthquakes, civil unrest, acts of terror, strikes or other labor problems, Internet service provider failures or delays, third party software or support provider failures or delays, bugs in third party software, or denial of service attacks, (iii) provide the Services only in accordance with applicable laws, and (iv) provide timely notification of any breach of Your Data. 3.2. Our Protection of Your Data. We shall maintain appropriate administrative, physical, and technical safeguards to protect the security, confidentiality, and integrity of Your Data. We shall not disclose Your Data except as compelled by law in accordance with Section 9.3 (Compelled Disclosure) or as expressly permitted in writing by You.
Use of the Infrastructure. The furnishing of the Units shall not be substantially modified by the Recipient (for instance, bringing in own furniture or painting the walls is prohibited). The Recipient undertakes to use the Infrastructure effectively, with due and proper care and undertakes to refrain from activities which may hamper enjoyment of the Services by the other recipients of the Bio-Accelerator, on the understanding that the Recipient will, at all times, have the right to perform his normal activities in the normal way, insofar as these activities are in line with the intended use of the Infrastructure. The Recipient shall ensure compliance with all statutory and regulatory obligations, requirements, licences, instructions of authorised bodies and authorities, which are relevant to the use of the Units by the Recipient, e.g. the environmental permit(s), any special authorisations related to the Recipient’s activities, the regulations and requirements with respect to fire protection, the General Regulations for Labour Protection (A.R.A.B.), the NBN standards, etc. (as regards the licences, insofar as they have not been applied for by the Service Provider; for instance, the Service Provider has applied for and obtained the environmental permit class 1 on behalf of the Recipient).

  • Infrastructure Infrastructure serves as the foundation and building blocks of an integrated IT solution. It is the hardware which supports Application Services (C.3.2) and IT Management Services (C.3.3); the software and services which enable that hardware to function; and the hardware, software, and services which allow for secure communication and interoperability between all business and application service components. Infrastructure services facilitate the development and maintenance of critical IT infrastructures required to support Federal government business operations. This section includes the technical framework components that make up integrated IT solutions. One or any combination of these components may be used to deliver IT solutions intended to perform a wide array of functions which allow agencies to deliver services to their customers (or users), whether internal or external, in an efficient and effective manner. Infrastructure includes hardware, software, licensing, technical support, and warranty services from third party sources, as well as technological refreshment and enhancements for that hardware and software. This section is aligned with the FEA/DoDEA Technical Reference Model (TRM) which describes these components using a vocabulary that is common throughout the entire Federal government. A detailed review of the TRM is provided in Section J, Attachment 5. Infrastructure includes complete life cycle support for all hardware, software, and services represented above, including planning, analysis, research and development, design, development, integration and testing, implementation, operations and maintenance, information assurance, and final disposition of these components. The services also include administration and help desk functions necessary to support the IT infrastructure (e.g., desktop support, network administration). Infrastructure components of an integrated IT solution can be categorized as follows:

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith.   • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • Access to Project Site Redeveloper shall permit the representatives of the City to enter Project Site at any and all reasonable times, as the City may deem necessary for the purposes of this Redevelopment Agreement, including but not limited to work and inspection of all work being performed in connection with the construction of the Redeveloper Improvements. Similarly, the City shall permit Redeveloper such entry upon the public rights of way for such purposes. No compensation shall be payable nor shall any charges be made in any form by any party for the access or inspection provided for in this Section. The City’s right of access granted under this Section shall terminate upon issuance by the City of the Redeveloper’s Certificate of Completion of Redeveloper Improvements. Notwithstanding the above, Redeveloper shall not be relieved of the provisions contained in Chapter 14.29 of the Lincoln Municipal Code regarding the use of streets for private construction purposes.

No employee shall be disciplined for refusal to work in a situation which is deemed unsafe beyond the reasonable requirements of the employee's job.

  • Access Toll Connecting Trunk Group Architecture 9.2.1 If CSTC chooses to subtend a Verizon access Tandem, CSTC’s NPA/NXX must be assigned by CSTC to subtend the same Verizon access Tandem that a Verizon NPA/NXX serving the same Rate Center Area subtends as identified in the LERG. 9.2.2 CSTC shall establish Access Toll Connecting Trunks pursuant to applicable access Tariffs by which it will provide Switched Exchange Access Services to Interexchange Carriers to enable such Interexchange Carriers to originate and terminate traffic to and from CSTC’s Customers. 9.2.3 The Access Toll Connecting Trunks shall be two-way trunks. Such trunks shall connect the End Office CSTC utilizes to provide Telephone Exchange Service and Switched Exchange Access to its Customers in a given LATA to the access Tandem(s) Verizon utilizes to provide Exchange Access in such LATA. 9.2.4 Access Toll Connecting Trunks shall be used solely for the transmission and routing of Exchange Access to allow CSTC’s Customers to connect to or be connected to the interexchange trunks of any Interexchange Carrier which is connected to a Verizon access Tandem.
