Use of the Program. As a condition to using the Program, Institution acknowledges and agrees that:
(a) Institution is permitted to use the Program only in accordance with all applicable laws and regulations, and the Program use guidelines set forth in the Device Enrollment Program Guide, as modified by Apple from time to time, and which will be made available on xxxx://xxx.xxxxx.xxx/iphone/business/it/management.html;
(b) Institution is not permitted to use the Program (or any part thereof) for any unlawful, inappropriate, or illegal activity;
(c) Institution is permitted to use the Program only to manage Authorized Devices for use by Authorized Users and not for general deployment to third parties, and Institution will be responsible for all use of the Authorized Devices by its Authorized Users;
(d) Institution will obtain all necessary rights and consents from its Authorized Users to deploy its Authorized Devices as permitted hereunder;
(e) Institution may add Administrators to the Program, but only if such individuals are employees or contractors of Institution or are Service Providers acting on Institution’s behalf, and Institution may add such parties only for account management purposes; and
(f) Institution is permitted to use the Program only for its own internal information technology purposes and is not permitted to provide a product or service to third parties that integrates with or leverages services or information provided by the Program or uses the Program in any way, unless otherwise agreed by Apple in writing.
Use of the Program. To the extent that the Program ever utilizes the services of a Licensor, Oakland Schools shall obtain a nontransferable license to use the Program, related technology, methodology and educational materials of Licensor to operate the Program, and School District shall observe the standards of operation of Licensor to preserve the services, reputation or intellectual property of Licensor.
Use of the Program. Your Institution has entered into the Apple Device Enrollment Program Agreement (“MDM Agreement”) with Apple, which permits Your Institution to automate Mobile Device Management (MDM) enrollment of Apple-branded products for use within Your Institution. Your Institution would like You to act as an administrator for purposes of account management of such Program, e.g., administering servers, uploading MDM provisioning settings and adding devices to Your Institution’s account (“Administrator”).
Use of the Program. (s). Anthology shall make the Program(s) available to Institution on the terms set forth in this Agreement and the License Schedules attached hereto. This Agreement grants Institution certain rights to access to the Program(s) as described herein. By accessing the software or otherwise using the Program(s), Institution agrees to be bound by the terms of this license. The Program(s) are designed for collective reporting of Institution Data. This data is reported online to a database hosted and maintained by Anthology that provides secure access for Institution via Institution username(s) and password(s), and in some cases, is designed to be combined with other institutional datasets.
Use of the Program. If the licensee, or any party to whom the licensee grants access to the program, inputs or records any information or data into the program, the licensee will be requested that this information or data, excluding any information or data that is confidential to the licensee, is provided to Sustainability Victoria, for the purpose of facility benchmarking studies. Sustainability Victoria will approach users on an annual basis for the transfer of data in the format required.
Use of the Program. 5.1 The Program shall be used only for the Council's own data processing and that of the Council’s subsidiaries, which includes but is not limited to Schools, Academy Schools, PVI’s and children’s centres and shall not be used to provide a data processing service to any other third party whether by trade or otherwise. Notwithstanding the foregoing, nothing in this clause shall prevent or prohibit the use of the Program for any purpose(s), by any person(s) and/or in any way(s) specified in Schedule 1.
5.2 The Council shall permit the Supplier, at all reasonable times and at the Supplier's expense, to verify that the use of the Program is within the terms of the Licence.
Use of the Program. When You become a licensed End User, You assume sole responsibility for determining the appropriateness of the Program for achieving your intended results. You further assume sole responsibility and all risk for the installation, use, and data and results obtained from the Program. You assume complete responsibility for the selection, installation, use, and placement of hardware with which You use the Program. Freedom Scientific does not warrant that the Program is suitable for Your particular purpose or use.
Use of the Program. (S)
2.1 ScanSoft agrees to use commercially reasonable efforts to market and sell the Program(s) to Customers in the Territory during the regular course of business and/or cause ScanSoft Distributors to do the same. 2.2 ScanSoft shall: [****] distribute the Program(s) in the Territory, and only in the form provided by IBM [****]
(a) distribute a copy of the International Program License Agreement ("IPLA") or ScanSoft's own end-user license agreement with terms reasonably consistent with the IPLA with each Program distributed to Customers; and
(b) provide Level 1 and Level 2 Support to Customers who have pxxxxxxxd the Program(s) in accordance with the support described in the Program.
2.3 ScanSoft shall not reverse assemble, reverse compile or otherwise translate any part of the Program(s).
2.4 ScanSoft shall ensure that its Distributors agree to act in a manner consistent with ScanSoft's obligations under this Agreement.
Use of the Program
