UTILIZATION F.S. I: - The Developer has shown the sanctioned plan to the Unit Purchaser which shows the Floor Space Index (FSI) presently available & unutilized F.S.I in respect to the said property. The Developer hereby declares that the Floor Space Index available as on date in respect of the said property is square meters only and the Developer has planned to utilize future construction potential of by availing of FSI available on payment of premiums or FSI available as incentive FSI by implementing various scheme or F.S.I. that may become available due to the handing over of roads etc. as mentioned in the Development Control Regulation or based on execution of increased FSI which may be available in future or modification to Development Control Regulations which are applicable to the said project and the T.D.R. The Developer has disclosed the construction potential as proposed to be utilized by him on the said property and the Unit Purchaser/s has agreed to purchase the said accommodation based on the proposed construction and sale of accommodations to be carried out by the Developer by utilizing the proposed FSI and on the understanding that the declared proposed FSI shall belong to Developer only. The plan of the said Accommodation/Unit is subject to amendments and changes as may be stipulated by the sanctioning authorities, Government, local authority and / or the requirements of the Developer. The Unit Purchaser/s has/ have agreed to purchase the said Apartment based the proposed construction and sale of apartments to be carried out by the Developer by utilizing the proposed FSI / TDR and on the understanding that the declared proposed FSI shall belong to Developer only. The Purchaser hereby agrees and gives his specific irrevocable consent, through the present Deed by executing a No-Objection Certificate/ Consent Deed, is attached ANNEXURE E, to the Developer to carry out such amendments, alterations, modifications and / or variations in constructing the said Accommodation/Unit, said Building on the said property and / or to the layout plan and / or to the Building plans (whether or not envisaged and / or constructed at present), provided that the location and the area / size of the said Accommodation/Unit agreed to be purchased by the Purchaser is not in any manner adversely affected.   • Utilization Scale STATE shall scale logs or portions of logs that are broken, wasted, or not removed by PURCHASER due to: (1) improper felling or bucking of the logs; (2) failure to remove the logs prior to deterioration; and (3) logs remaining on the timber sale area after completion of logging, provided the logs were merchantable prior to breakage or wastage. Material used to meet down material requirements in the section titled, "Reserved Timber," shall not be considered for utilization scale. PURCHASER shall pay for the logs at the contract price designated in Section 44. STATE shall notify PURCHASER of the volume of logs so scaled. Payment shall be considered due on such volume as if the logs were removed on the date of said notification. In the event PURCHASER disagrees with the findings made by STATE under this section, PURCHASER may furnish scaling by a third-party scaling organization acceptable to STATE. Costs and expenses of such third party shall be paid for by PURCHASER, and the findings of the third party shall be final.

  • Service Availability You understand that Service availability is at all times conditioned upon the corresponding operation and availability of the communication systems used in communicating your instructions and requests to the Credit Union. This over-provisioning is an inefficient deployment and use of network resources and results in unnecessary costs. Those situations where more capacity exists than actual usage will be handled in the following manner:

  • Utilization Reports Both the Contractor and Subcontractor shall complete Quarterly Utilization Reports (or similar type documents containing the same information) and submit them to the Contracting Officer and to the Bureau within ten (10) business days at the end of each quarter. This information will be used to determine the actual dollar amount paid to Subcontractor and will also serve as a record of fulfillment of Contractor’s Small Diverse Business and Small Business Commitments. If there was no activity during the quarter, then the form must be completed by stating “No activity in this quarter.” A late fee of $100.00 per day may be assessed against the Contractor if its Utilization Report is not submitted in accordance with the schedule above.
