Vacancy Defined. Vacancies in bargaining unit positions are those non-promotional positions vacated as a result of death, resignation, retirement, termination of contract, non-renewal of contract, transfer, or the grant of a disability leave of absence for a duration of one year or more, promotion or the creation of a new position. The existence of a vacancy and selection of the person to fill that vacancy shall be determined by the Superintendent. When the Superintendent determines that a vacancy is to be filled it shall be filled as follows:
