Common use of Vacation Rules Clause in Contracts

Vacation Rules. The following rules shall govern the use of vacation: A. A member who is separated from City service through removal, reassignment, retirement or a layoff and who has unused vacation leave to his or her credit, shall be paid in a lump sum for such unused vacation leave to his or her credit at the time of separation. B. Upon the death of a member, any unused vacation leave to his or her credit shall be paid in a lump sum to the surviving spouse or, secondarily, to the estate of the deceased. The leave shall be paid out at the member’s current rate of pay at the time of death. C. All vacation hours shall be paid in full pay at the applicable straight time rates. D. Members on vacation leave may be recalled to duty for extraordinary situations as determined by the Employer; however, if a member is ordered to work while on approved vacation leave he or she shall be paid at one and one-half (1½) times his or her regular rate of pay for all hours worked. The period of time the member is called back to work will not be deducted from his vacation time. E. Vacation time shall be taken in increments of at least one (1) hour, unless otherwise approved by the Chief. F. Vacation credit shall not be earned while a member is in non-pay status (unpaid leave of absence, disciplinary suspension, etc.).
