VALUE FOR MONEY PROVISIONS. 13.1 The Supplier shall comply in every respect with the provisions of Framework Schedule 6 to ensure that best value is delivered to the Authority and any Other Contracting Body under any and all Call-Off Agreements entered into under this framework.

VALUE FOR MONEY PROVISIONS. BACKGROUND The Supplier acknowledges that the Authority wishes to ensure that: the Available Services represent value for money to the taxpayer throughout the Term of this Framework Agreement and deliver savings against the previous spends of Contracting Bodies for these or similar but non-Cloud services. This Framework Schedule [6] (Value for Money Provisions) sets out the following processes to ensure this Framework Agreement represents value for money throughout the Term: BENCHMARKING The Authority reserves the right to apply a benchmarking process whereby the costs and benefits of the Supplier’s service offerings can be measured and compared to those of other Suppliers. The outcome will be published within the procurement vehicle for the benefit of potential contracting bodies and their possible use in determining which service offering represents best value for money. Suppliers will be informed of the outcome of benchmarking as it applies to them. They will be informed of where they suffer by comparison with other service offerings in order that they might know where they need to improve. FRAMEWORK SCHEDULE 7

VALUE FOR MONEY PROVISIONS. BACKGROUND The Supplier acknowledges that the Authority wishes to ensure that: the Available Services, and the air ticket prices and accommodation rates booked represent value for money to the taxpayer throughout the Term of this Framework Agreement. This Framework Schedule [6] (Value for Money Provisions) sets out the following processes to ensure this Framework Agreement represents value for money throughout the Term: Most Favoured Customer Benchmarking Continuous Improvement Gainshare MOST FAVOURED CUSTOMER The Supplier undertakes that when dealing with its Contracting Bodies and potential Contracting Bodies from time to time it shall not discriminate against the Authority. In particular, but without limitation, the Supplier shall not during the Term enter into a contract with any other customer for the provision of services substantially similar to the Available Services at prices or other terms and conditions which, taken together, are more favourable to that customer than those available under this Framework Agreement ("Preferable Terms"), unless it first offers to provide those Preferable Terms to the Authority pursuant to Clause 32 (Variations). If the Supplier discriminates against the Authority by failing to provide the Authority with the benefit of Preferable Terms the Authority shall be entitled to escalate the matter for resolution in accordance with Clause 43 (Dispute Resolution), provided that if the matter is not resolved by the such dispute resolution procedures within twenty (20) Working Days of such escalation, the Authority shall be entitled to terminate this Framework Agreement without any further liability to the Supplier.

  • Statutory Provisions Any statutory or regulatory reference in this Agreement shall include a reference to any successor to such statute or regulation and/or revision thereof.

  • Pay Provisions An employee who serves on a safety and health committee shall receive his regular rate of pay for attending meetings of the Committee held during working hours and for investigations by the Safety Committee.

  • Injury Pay Provisions An employee who is injured on the job during working hours and is required to leave for treatment or is sent home for such injury, shall receive payment for the remainder of his/her shift, without deduction from sick leave.

  • Severability of Provisions If any one or more of the covenants, agreements, provisions or terms of this Agreement shall be for any reason whatsoever held invalid, then such covenants, agreements, provisions or terms shall be deemed severable from the remaining covenants, agreements, provisions or terms of this Agreement and shall in no way affect the validity or enforceability of the other provisions of this Agreement or of the Certificates or the rights of the Holders thereof.

  • Penalty Provisions Failure to comply with the regulatory requirements is a violation of state law that may result in penalties up to ten thousand nine hundred ten dollars ($10,910.00 USD) for strict liability violations for each day in which the violation occurs.   • Severability of Invalid Provisions If any provision of this Lease shall be held to be invalid, void or unenforceable, the remaining provisions hereof shall not be affected or impaired, and such remaining provisions shall remain in full force and effect.
