VIOLATION OF MEMBERSHIP RULES. In the event the Gardener violates any of the Community Garden’s rules, policies, or practices, the Gardener will be issued a written notification by the Township and will be provided with a reasonable opportunity to correct the violation. In the event no correction is made and no response to the notification is received within two weeks of the date of the notification, a second notice will be issued. If the second notice is not addressed or responded to within one week of the date of notification, a final notice will be issued informing the Gardener if the suspension of their gardening privileges and forfeiture of their plot. All rules, terms and conditions of participating in the Xxxxxx Township Community Garden are established by the Township of Xxxxxx. By executing this Agreement, the Gardener acknowledges and agrees that in the event the Gardener violates any of the rules, terms and conditions set forth herein, at the sole discretion of the Township, the Gardener’s participation may be immediately suspended and may result in the permanent loss of the use of the Gardener’s plot. There will be no refund given for revoked Garden privileges.

VIOLATION OF MEMBERSHIP RULES. In the event the Gardener violates any of the Community Garden’s rules, policies, or practices, the Gardener will be sent notification by the Garden Leads or the Borough and will be provided with reasonable opportunity to redress/correct the violation. In the event that no redress/correction is made and no response to the notification is received within a reasonable time from the date of the notification, a second notice will be issued. If no redress/correction is made and no response is received or action to address situation implemented, following a subsequent notice, a final notice will be issued informing the Gardener of the Suspension, or total forfeiture of gardening privileges and access to the garden plot(s). Please note that, at the discretion of the Borough a Gardener’s violation of any rules may result in the Gardener being prohibited from future participation in the Community Garden until the gardener is able to adhere to the garden requirements. All rules, terms and conditions of participation with the Borough of North Haledon Community Garden are established by Borough of North Haledon. By executing this Agreement, the Gardener acknowledges and agrees that in the event that Gardener violates any of the rules, terms and conditions set forth herein, at the sole discretion of the Borough, the Gardener’s participation may be immediately suspended and may result in permanent loss of the use of the Gardener’s plot. There will be no refund for suspension as the membership and registration fees are non-refundable.
VIOLATION OF MEMBERSHIP RULES. Use of the community garden is a privilege. The Township reserves the right to revoke the use of the community garden by any person for failure to observe the rules and regulations established in this Agreement. Upon Violation of any rule or regulation, a written notice will be issued and the violator will be given a reasonable opportunity to correct the violation. If the violation does not cease or is not cured within fourteen (14) calendar days, a second written notice will be issued. If the violation has not ceased or been cured within seven (7) calendar days of the second notice, the use of the community garden for the remainder of the season may be revoked and the plot may be reassigned. Any person whose permission to use a plot is revoked may appeal to the Township Administrator who shall adjudicate the appeal within twenty-one (21) calendar days of the date of notice of the revocation.
