WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. The Board and the Association shall acknowledge that during negotiations resulting in any agreement, each party had the right, subject to the limitations of law and this procedure, and the opportunity to make demands and proposals with respect to any matter not removed thereby, and that said agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the Association shall agree that negotiations with respect to any subject or matter (except those subjects or matters required by the Ohio Revised Code) may not occur within the duration of this agreement unless by mutual agreement.
WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. The Board and the Union, subject to the limitation of law, agree that after an agreement has been reached, both parties shall voluntarily waive, during the term of the agreement, the right to re-open negotiations unless agreeable to both parties.
WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. A. After the Agreement has been officially approved by the CFEA and the Board of Education, both parties waive the right to initiate further negotiations on the matters included in this Agreement, during the period covered by this Agreement unless the parties mutually agree to reopen negotiations. The written provisions of this contract represent complete collective bargaining and full agreement by the parties with respect to rates of pay, wages, hours and other terms and conditions of employment which shall prevail during the term hereof.
B. The Board of Education and the CFEA acknowledge that during the negotiations which preceded this Agreement, each had the unlimited right and opportunity to make demands and proposals with respect to any subject matter not removed by law from the area of collective bargaining and that the understanding and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement.

Further, unless there is a mutually signed memorandum of understanding to the contrary, the Board and the Association shall voluntarily waive, during the life of said agreement, said rights and each agree that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject is specifically referred to or covered in said agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed said agreement.

The Board and the Association each acknowledge that during negotiations resulting in this agreement, each party had the right, subject to the limitations of law, to bargain on any and all issues it desires and that this agreement was arrived at by the parties after the exercise of that right and each party does therefore waive, during the life of this agreement, the right to bargain on any other issues, and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter outside of, referred to or covered in this agreement unless the subject matter is mutually agreed to by both parties.

The Board and the Union shall acknowledge that during negotiations resulting in any agreement, each party had the right, subject to the limitations of law and this procedure, and the opportunity to make demands and proposals with respect to any matter, and that said agreement was arrived at by the parties after the exercise of the right and opportunity. Further, the Board and the Union waive, during the term of this agreement, the right to negotiate a matter unless mutually agreed upon. If any provision of this document, or any application of the provisions of this document, or any agreement reached under its terms, conflicts with any federal or state law, now or hereafter enacted or issued, such provision (only to the extent such provision, application or agreement is in conflict with any federal or state law), application or agreement shall be inoperative. Further, the Board and the Union waive, during the term of this agreement, the right to negotiate a matter unless mutually agreed upon.

The Board and the BEA acknowledge that during the negotiations resulting in this agreement, each party had the right and the opportunity to make demands and proposals with respect to any matter, and that this agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the BEA shall voluntarily waive said rights during the life of this Agreement, and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter, irrespective of whether such matter or subject is specifically referred to or covered in this Agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the parties signed this Agreement.

The Board and the Association acknowledge that during the negotiations which resulted in this Agreement, each party had the right and the opportunity to make demands and proposals with respect to any subject matter within the scope of negotiation. This Agreement was reached after the exercise of that right and opportunity by the parties. Therefore, for the life of this Agreement, the Board and the Association each voluntarily and unqualifiedly waive the right to negotiate as well as agree that the other party shall not be obligated to negotiate any subject or matters:
a. to which reference is made in this Agreement, or b. which is covered in this Agreement, or
