WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. The Board and the Association shall acknowledge that during negotiations resulting in any agreement, each party had the right, subject to the limitations of law and this procedure, and the opportunity to make demands and proposals with respect to any matter not removed thereby, and that said agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the Association shall agree that negotiations with respect to any subject or matter (except those subjects or matters required by the Ohio Revised Code) may not occur within the duration of this agreement unless by mutual agreement.
WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. The Board and the Union, subject to the limitation of law, agree that after an agreement has been reached, both parties shall voluntarily waive, during the term of the agreement, the right to re-open negotiations unless agreeable to both parties.
WAIVER OF NEGOTIATIONS DURING TERM OF AGREEMENT. A. After the Agreement has been officially approved by the CFEA and the Board of Education, both parties waive the right to initiate further negotiations on the matters included in this Agreement, during the period covered by this Agreement unless the parties mutually agree to reopen negotiations. The written provisions of this contract represent complete collective bargaining and full agreement by the parties with respect to rates of pay, wages, hours and other terms and conditions of employment which shall prevail during the term hereof.

Further, unless there is a mutually signed memorandum of understanding to the contrary, the Board and the Association shall voluntarily waive, during the life of said agreement, said rights and each agree that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject is specifically referred to or covered in said agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed said agreement.

The Board and the Association each acknowledge that during negotiations resulting in this agreement, each party had the right, subject to the limitations of law, to bargain on any and all issues it desires and that this agreement was arrived at by the parties after the exercise of that right and each party does therefore waive, during the life of this agreement, the right to bargain on any other issues, and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter outside of, referred to or covered in this agreement unless the subject matter is mutually agreed to by both parties.

The Board and the Union voluntarily waive, during the life of this Agreement, said rights and each agrees that the other will not be obligated to negotiate with respect to any subject or matter irrespective of whether such matter or subjects are specifically referred to or covered in this agreement.

The Board and the Association acknowledge that during the negotiations which resulted in this Agreement, each party had the right and the opportunity to make demands and proposals with respect to any subject matter within the scope of negotiation. This Agreement was reached after the exercise of that right and opportunity by the parties. Therefore, for the life of this Agreement, the Board and the Association each voluntarily and unqualifiedly waive the right to negotiate as well as agree that the other party shall not be obligated to negotiate any subject or matters:

The Board and the Association acknowledge that during negotiations resulting in this contract, each party had the right and the opportunity to make demands and APPENDIX A LEAVES FORM A APPLICATION FOR FAMILY MEDICAL LEAVE Check one: I hereby apply for family/medical leave for the following reason: because of the birth of my son or daughter and in order to care for my son or daughter because of the placement of a son or daughter with me for adoption or xxxxxx care in order to care for my spouse, or a son, daughter, or parent who has a serious health condition because of my serious health condition that makes me unable to perform the functions of my position I certify that I meet the eligibility requirements as set forth in the Family and Medical Leave Policy. If I am applying for leave because I have a serious health condition or a member of my family does, I am also supplying medical certification in accordance with the Family Medical Leave Policy. If I am applying for leave because I have a serious health condition, I authorize the Superintendent to contact my treating health care provider for information about my condition. I agree to cooperate fully with my treating health care personnel with knowledge of my condition to communicate with Shawnee Schools for the purpose of determining my condition. I agree to report on a monthly basis to my supervisor my status and intent to return to work during my leave. I further agree that if my leave is due to my own serious health condition that before being permitted to return to work, I will present a certification from my health care provider that I am able to resume work. I understand that I must pay my portion of health benefits according to the payroll deduction schedule and related practices. I further understand that if I do not return to work after my leave for any reasons but a continuation, recurrence or onset of a serious health condition or other circumstances beyond my control, I will be obligated to repay to the Board the amount of my health insurance premiums it contributed on my behalf during my leave.
