Warranty for IBM Machines. IBM warrants that each IBM Machine is free from defects in materials and workmanship and conforms to its Specifications. The warranty period for an IBM Machine is a fixed period commencing on its Date of Installation and specified in a Transaction Document. During the warranty period, IBM provides repair and exchange Service for the IBM Machine, without charge, under the type of Service IBM designates for the IBM Machine. If an IBM Machine does not function as warranted during the warranty period and IBM is unable to either i) make it do so or ii) replace it with one that is at least functionally equivalent, Customer may return it to IBM for a refund. Additional terms regarding Service for Machines during and after the warranty period are contained in Part 5.
Warranty for IBM Machines. We warrant that each IBM Machine: • conforms to its Specifications; and • is free from defects in materials and workmanship. The warranty period for an IBM Machine is a specified, fixed period which begins on its Date of Installation. If we are unable to do so, you may return it to us and we will refund your money. During the warranty period, we will provide service under the type of service designated for the Machine (at no additional charge), or under the "Warranty Option" you have selected, at the rate which is in effect at that time. After the warranty or Warranty Option expires, your IBM Machine will be automatically covered under Maintenance Services. This is described in the section on ServicePlan Maintenance Services. We provide warranty service for an IBM Machine feature, conversion or upgrade, only if the IBM Machine on which it is installed is: • the designated, serial-numbered IBM Machine; and • at the proper engineering-change level. During its warranty period, we will manage and install engineering changes that apply to an IBM Machine.

Program Services are available for a warranted ICA Program for at least one year following its general availability. If an ICA Program does not function as warranted during the first year after you obtain your license and IBM is unable to make it do so, you may return the ICA Program and your money will be refunded. To be eligible, you must have obtained your license while Program Services (regardless of the remaining duration) were available for it. Warranty for IBM Services IBM warrants that it performs each IBM Service using reasonable care and skill and according to its current description (including any completion criteria) contained in this Agreement, an Attachment, or a Transaction Document. Warranty for Systems Where IBM provides Products to you as a system, IBM warrants that they are compatible and will operate with one another. This warranty is in addition to IBM’s other applicable warranties.
Warranty for IBM Machines. The warranty for IBM Machines acquired in Western Europe is valid and applicable in all Western Europe countries, provided that the Machines have been announced and made available in such countries. For the purposes of this section, Western Europe means the following countries: Andorra, Austria, Belgium, Bulgaria, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, San Marino, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, Vatican State, and any country subsequently added to the European Union, as from the date of accession. IBM warrants that each IBM Machine is free from defects in materials and workmanship and conforms to its Specifications. The warranty period for an IBM Machine is a fixed period specified in a Transaction Document. For Machines, unless otherwise specified, the Date of Installation is the Warranty Start Date. For us to provide warranty service for a feature, conversion, or upgrade, we require that the Machine on which it is installed be 1) for certain Machines, the designated, serial-numbered Machine and 2) at an engineering-change level compatible with the feature, conversion, or upgrade. During the warranty period, we manage and install engineering changes that apply to the Machine. If a Machine does not function as warranted during the warranty period, we will repair it or replace it with one that is at least functionally equivalent, without charge. If we are unable to do so, you may return it to us and we will refund your money.
