Waters of the U. S. Determination (Streams and Wetlands) Xxxxxx-Xxxx, through the use of a sub-consultant, will provide a Waters of the US Determination (i.e. streams and wetlands) for the project area. In performing the jurisdictional determinations, the 1987 Corps of Engineers Wetlands Delineation Manual and the 2012 Regional Supplement: Eastern Mountains and Piedmont Region, Version 2.0, will be closely followed to establish a description of the soils, plants and hydrologic conditions of the site. Waters of the U. S. Note that this does not include unvegetated areas such as streams, ponds, and most tidal shores; these are other “waters of the U.S.”. Large, year-round open water bodies in the project area are mapped as ponds. All mapped ponds are on Xxxxxxx Island and are coded as PUBH (palustrine, unconsolidated bottom, permanently flooded bodies of water).
Waters of the U. S. Reconnaissance Performance Objective: The Contractor shall conduct a water reconnaissance survey of the number of acres specified in the Task Order to determine what water resources occur within the area and whether any are potentially regulated.

The Consultant will include the evaluation of impacts to wetlands and Waters of the U.S. (WOUS) in the NEPA document (from wetland determinations only) and will discuss the process followed to comply with the Clean Water Act and applicable executive orders (practicable alternatives, mitigation measures, etc.). Follow-on delineations and obtaining a Nationwide or Individual 404 Permit and development of a mitigation plan is not included in this Scope of Services.
Waters of the U. S. (WOTUS) Report – This work includes preparation of the WOTUS report to formally document all water resources located within the project(s) limits. This report is necessary as it will present all water resources within the project so any impacts can be properly permitted. This will also include completion of the Indiana Department of Natural Resources Heritage Database Search and U.S. Fish and Wildlife Service IPac species list.

  • Powers of the Board The Board shall have the power to do any and all acts necessary, convenient or incidental to or for the furtherance of the purposes described herein, including all powers, statutory or otherwise.   • Extensions of Time 34.1 If at any time during performance of the Contract, the Supplier or its subcontractors should encounter conditions impeding timely delivery of the Goods or completion of Related Services pursuant to GCC Clause 13, the Supplier shall promptly notify the Procuring Entity in writing of the delay, its likely duration, and its cause. As soon as practicable after receipt of the Supplier's notice, the Procuring Entity shall evaluate the situation and may at its discretion extend the Supplier's time for performance, in which case the extension shall be ratified by the parties by amendment of the Contract.
