Whole Taking. If the whole of the Building or Premises is lawfully taken by condemnation or in any other manner for any public or quasi-public purpose, this Lease shall terminate as of the date of such taking, and Rent shall be prorated to such date.
Whole Taking. If the whole of the Premises shall be acquired by any authority having the power of eminent domain (referred to as a “Taking”), this Lease shall automatically terminate as of the date title shall vest in the condemning authority.
Whole Taking. If the entire Building or a substantial part thereof is taken or condemned by any competent authority for any public or quasi-public use or purpose, the Term of this Lease shall end upon and not before the earlier of the date when the possession of the part so taken is required for such use or purpose or the effective date of the taking, and without apportionment of the award to or for the benefit of Tenant. If any condemnation proceeding is instituted in which it is sought to take or damage any part of the Building, the taking of which, in Landlord's opinion, would prevent the economical operation of the Building, or if the grade of any street or alley adjacent to the Building is changed by any competent authority, and such taking, damage or change of grade makes it necessary or desirable to remodel the Building to conform to the taking, damage or changed grade, Landlord shall have the right to terminate this Lease upon not less than ninety (90) days' notice prior to the date of termination designated in the notice. In either of these events, Rent at the then current rate shall be apportioned as of the date of the termination. No money or other consideration shall be payable by Landlord to Tenant for the right of termination, and Tenant shall have no right to share in the condemnation award, whether for a total or partial taking, for loss of Tenant's leasehold or improvements or other loss or expenses or in any judgment for damages caused by the change of grade. Tenant may however file a separate claim for Allocation expenses and for any of Tenant's personal property taken, provided such claim does not reduce Landlord's award.
Whole Taking. If the Building or the Site is lawfully taken by ------------ condemnation or in any other manner for any public or quasi-public purpose by a duly constituted authority or agency having jurisdiction (a "Taking"), and such Taking is of the whole Building or the Site ("Whole Taking"), this Lease shall terminate as of the date the condemning authority takes title or possession, whichever occurs first ("Taking Date"), and Rent shall be prorated to the Taking Date.
Whole Taking. If the whole of the Premises, or so much thereof, including however a portion of the Building and other improvements, shall be taken or condemned for a public or quasi-public use or purpose by any competent authority and as a result thereof the balance of the Premises cannot be used for the same purpose as expressed in Paragraph 18(a), then and in either of such events, the term of this Sublease shall terminate when possession of the Premises shall be so taken and surrendered, and any award, compensation or damages (hereinafter sometimes called the "award"), shall be paid to and be the sole property of Sublessor whether such award shall be made as compensation for diminution of the value of the leasehold or the fee of the Premises or otherwise and Sublessee hereby assigns to Sublessor all of Sub1essee's right, title and interest in and to any and all such award. Sublessee shall continue to pay rent until the term of this Sublease is terminated and any taxes and insurance premiums paid by Sublessee, shall be adjusted between the parties.
Whole Taking. If the whole of the Shopping Center, Building or Premises is lawfully taken by condemnation or in any other manner for any public or quasi-public purpose, this Lease shall terminate as of the date of such taking, and Rent shall be prorated to such date.
Whole Taking. If the whole of the Leased Premises is taken by condemnation, eminent domain or in any other manner for any public or quasi-public purpose (a “Taking”), this Lease shall terminate as of the date the condemning authority takes title or possession, whichever occurs first, provided, however, that Tenant’s obligation to pay all Rent due hereafter to Landlord shall continue in full force and effect notwithstanding any technical termination of this Lease by virtue of such Taking and Landlord shall have all remedies available hereunder in the event that Tenant fails to pay any such Rent when due notwithstanding that the Taking occurred.
Whole Taking. If the whole of the Building or the whole of the Premises shall be acquired by a Taking, or if the whole of the Automobile Parking Area is acquired by a Taking then this Lease shall terminate as of the date of taking possession by the Taking authority.
Whole Taking. If the whole of the Premises shall be taken or condemned for a public or quasipublic use or purpose by any competent authority or if such a portion of the Premises, including any portion of the improvements, shall be so taken that as a result thereof the balance is not suitable for Tenant's continued use or occupancy, then in either of such events, the Lease term shall terminate the day before Landlord makes delivery of possession to the condemning authority and any award, compensation or damages (hereinafter sometimes called "award") shall be paid to and be the sole property of Landlord whether such award shall be made as compensation for diminution of the value of the leasehold or the fee of the Premises or otherwise and Tenant hereby assigns to Landlord all of Tenant's right, title and interest in and to any and all such award. However, if Tenant receives compensation or award for moving expenses, Tenant shall be entitled to the full amount of such moving compensation award. Likewise, if Tenant receives compensation for any leasehold improvements, alterations or enhancements, not of a permanent nature and paid for by Tenant during the term of this Lease then Tenant shall be entitled to the full amount of such compensation. Tenant shall continue to perform all of the covenants and provisions of this Lease, including the payment of rent, tax installments and all items of additional rent which shall become due and payable until Tenant is required to vacate the Premises as stated above, which is the day before Landlord makes delivery of possession to the condemning authority.
Whole Taking. If the whole or any part of the leased premises shall be taken for any public or any quasi-public use under any statute or by right of eminent domain, or by purchase under threat of condemnation, then this Lease shall automatically terminate as of the date that title shall be taken.
